<br />CASSELBERRY CITY COMMISSION <br />Minutes of JUDe 23, 2008 - Regular Meeting <br />Page 8 ofl7 <br /> <br />BALANCING LAND USE AND TRANSPORTATION"; AMENDING THE FUTURE <br />LAND USE ELEMENT BY ESTABLISHING A "MAJOR THOROUGHFARE MIXED <br />USE" DISTRICT WITHIN A DESIGNATED AREA OF THE CITY FOR PROPERTIES <br />KNOWN AS THE "CONCORD CENTER" AND THE "CITY CENTER" GENERALLY <br />DESCRIBED AS "MID TO HIGH DENSITY /INTENSITY MIXED-USE DEVELOPMENT <br />ALONG AN ARTERIAL"; PROVIDING FOR TRANSMITTAL OF THE PLAN <br />AMENDMENTS TO THE DEPARTMENT OF COMMUNITY AFFAIRS; PROVIDING <br />FOR COD/FICA nON, CONFLICTS, SEVERABILITY, AND AN EFFECTIVE DATE." <br /> <br />Notice of Public Hearing: Notice of Public Hearing for Ordinance 08-1240 was published in the Orlando <br />Sentinel on June 12,2008. A sign up sheet was provided for any individuals wishing to receive further <br />information regarding Ordinance 08-1240, pursuant to State law. <br /> <br />Staff Presentation: Mr. Gerald Paradise, Community Development Director, stated the purpose of <br />Ordinance 08-1240 was to add a Transportation Concurrency Exception Area and a new future land use <br />category, "Major Thoroughfare Mixed-Use" to the City of Casselberry's Comprehensive Plan by amending <br />policy statements within both the Future Land Use Element and the Traffic Circulation Element. <br /> <br />The City of Casselberry is the applicant for the Transportation Concurrency Exception Area (TCEA). This <br />area is the same as the Community Redevelopment District that is located along U.S. Highway 17-92 and <br />a portion of State Road 436. Conditions for the approval of the TCEA by the Department of Community <br />Affairs include various mobility strategies proposed by the City. These strategies and their performance <br />measures need to be incorporated into the City's Traffic Circulation Element. Other objectives and policies <br />within the Future Land Use Element have also been amended to reflect the TCEA strategies. The TCEA <br />Study findings were based on higher development intensities (Floor Area Ratios) and densities (Dwelling <br />Units per Acre) within the TCEA. Currently the properties within this area have "Commercial" or High <br />Intensity Non-Residential" Future Land Use designations that provide a maximum of .50 floor area ratio. <br />The new "Major Thoroughfare Mixed-Use" designation will enable more compact development opportunities <br />within the CRD. Justification for the proposed changes were provided in the TCEA Study which was <br />approved by passage of Resolution 08-1890. <br /> <br />The Planning & Zoning Commission, acting as the Local Planning Agency (LP A), reviewed and unanimously <br />recommended approval ofLPA 08-06 at their May 28, 2008 meeting. <br /> <br />Budget Impact: This item will not impact the budget. <br /> <br />Recommendation: The City Manager and the Community Development Director recommended approval <br />of Ordinance 08-1240 on first reading. <br /> <br />Public Hearing: The following individual came forward and addressed Ordinance 08-1240: <br /> <br />1) Mr. John Casselberry, 700 South Lost Lake Lane, was in favor of the ordinance as long <br />as there is two separate designations between mixed use and true retail. <br /> <br />No one else came forward. Mayor Goff closed the public hearing relative to Ordinance 08-1240. <br />
