<br />CASSELBERRY CITY COMMISSION <br />Minutes of June 23, 2008 - Regular Meeting <br />Page 13 of17 <br /> <br />EFFECTIVE DATE." <br /> <br />Staff Presentation: Police Chief John Pavlis stated the use of red light cameras as a means of supplementing <br />law enforcement personnel has proven to be effective in enforcing the laws requiring drivers of motor <br />vehicles to stop for red lights and also will free up law enforcement personnel to respond to other and <br />sometimes more significant incidents, as well as serious crimes. Ordinance 08-1246 provides for use of <br />unmanned cameras/monitoring devised for red lights in the City. Elements of the program include the <br />following: <br /> <br />. 30 day public announcement and public awareness campaign prior to the proposed use of the traffic <br />control signal monitoring devices <br />Owner of the vehicle cited being responsible for the infraction <br />Civil penalty of$125 for each violation ofthis Ordinance <br />Owner affidavit of non-responsibility under certain specified circumstances <br />Designation ofa traffic control infraction review officer to review violations and testif'y at an appeal <br />Appeal hearing process with a City-appointed hearing officer <br /> <br />Budget Impact: It is anticipated that any costs associated with the appeal process and hearing officer <br />program will be offset by fines and administrative costs authorized by Ordinance 08-1246. <br /> <br />Recommendation: The City Manager and the Police Chief recommended approval of Ordinance 08-1246 <br />on first reading and requested the second reading and public hearing be set for July 14, 2008. <br /> <br />MOTION: <br /> <br />Commissioner Doerner moved to approve Ordinance <br />08-1246 on first reading as presented. Motion was <br />seconded hy Vice Mayor Hufford. Motion carried <br />unanimously by voice vote 5 - O. <br /> <br />11. RESOLUTIONS <br /> <br />A. Resolution 08-1897 - City of CasselbelTV vs. Rowan South Construction Lawsuit <br />Settlement Agreement and Related Budget Transfer #08-042 <br /> <br />The City Clerk read Resolution 08-1897 by title as follows: <br /> <br />"A RESOLUTION OF THE CITY OF CASSELBERRY, FLORIDA, AUTHORIZING THE <br />EXECUTION OF A SETTLEMENT AGREEMENT BETWEEN ROW AN SOUTH <br />CONSTRUCTION, INC., ET AL., AND THE CITY OF CASSELBERRY; PROVIDING <br />FOR CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE." <br /> <br />Staff Presentation: Ms. Catherine Reischmann, City Attorney stated mediation for the lawsuit filed by the <br />City against the contractor, Rowan South Construction, related to the mold problem at Fire Station 21 took <br />place on June 12,2008. Mediation to settle the case outside ofthe court was sought before a trial date was <br />
