<br />CASSELBERRY CITY COMMISSION <br />Minutes of June 23, 2008 ~ Regular Meeting <br />Page 12 of17 <br /> <br />DISCUSSION: <br /> <br />Vice Mayor Hufford, Commissioner Solomon and Commissioner Doerner <br />stated they would be voting against the dismissal because they supported <br />staffs method of measurement. Commissioner Miller stated he was <br />compelled by the argument and case law presented by the applicant and <br />would be voting for the dismissal. Mayor Goff stated he would be voting <br />in favor of the motion because of the City Code and the grassy area that has <br />been included in the staffs method of measurement. Ms. Lipscomb <br />requested Mr. Paradise provide additional photos of the grassy area for <br />review by the Commission. Mr. Paradise stated the area is mowed and kept <br />in good condition and is not a drainage area. <br /> <br />Motion failed 2 - 3 (Commissioner Doerner, <br />Commissioner Solomon and Vice Mayor Hufford <br />dissenting) by voice vote. <br /> <br />Mr. Calzada came forward and stated he disagreed with the staffs analysis of the request and non- <br />conformance with the variance criteria, and felt the applicant had met all six (6) variance criteria. The City <br />Attorney reviewed the six (6) variance criteria utilized for review and analysis of the request. <br /> <br />Public Hearing: No one came forward to address the variance request. <br /> <br />MOTION: <br /> <br />Vice Mayor Hufford moved to deny Variance Request <br />BA 08-05 for the Rice & Beans Club. Motion was <br />seconded by Commissioner Solomon. Motion carried <br />3 - 2 (Commissioner Miller and Mayor Goff dissenting) <br />by voice vote. <br /> <br />10. FIRST READING OF ORDINANCES <br /> <br />A. First Readinl! of Ordinance 08-1246 - Traffic Lil!ht Safety Ordinance <br /> <br />The City Clerk read Ordinance 08-1246 by title as follows: <br /> <br />"AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF CASSELBERRY, <br />FLORIDA, RELATING TO TRAFFIC LIGHT SAFETY; PROVIDING FOR <br />LEGISLATIVE FINDINGS INTENT/PURPOSE; PROVIDING FOR INTENT AND <br />DEFINITIONS; ESTABLISHING AN ENFORCEMENT PROGRAM WITHIN THE CITY; <br />AUTHORIZING THE CITY TO PERMIT AND IMPLEMENT THE USE OF <br />UNMANNED CAMERASIMONITORING DEVICES FOR RED LIGHT INFRACTIONS; <br />PROVIDING ENFORCEMENT PROCEDURES, INCLUDING NOTICE, APPEAL <br />HEARINGS, PENALTIES, IMPOSITION OF ADMINISTRATIVE CHARGES AND <br />COLLECTION; PROVIDING FOR EXCEPTIONS; PROVIDING FOR THE <br />ESTABLISHMENT OF HEARING OFFICERS AND MATTERS RELA TINGTHERETO; <br />PROVIDING FOR SEVERABILITY, CODIFICATION, CONFLICTS, AND AN <br />
