Testimony continued. The issue is he put up a a <br />pem1it. It was a wooden wall that the City is saying he doesn't have a permit for, on top of the wooden wall is <br />the chicken wire fence; he had a pem1it for a fence but not a chicken wire fence <br /> <br />Mr. Hendcrson asked if a pe11l1it is applied for and Mr. Pieski gets it everything is fine. <br /> <br />Mr. Ruf stated everything would be fine with the wall. <br /> <br />Mr. Henderson asked ifhe takes down the chicken \"lire down he would then be in compliance with that issue <br />and he already has a pel1nit for vinyl fence at some point when he can atford to due so. The next issue is sheds, <br />\vhich there may be somc issue with and not sure if any the Board members have the answer. Mr. Henderson <br />stated the Board certainly wouldn't want him to tear the sheds down, but at the same time he has to come into <br />compliance. <br /> <br />Discussion. <br /> <br />Mr. Ruf stated that there is a property dispute between the HOA and Mr. Pieski, about who actually owns the <br />propelty were the sheds are laid to rest. The City is only empowered to issue pennits to do work on the persons <br />own property. The City can't issue the permit because the property isn't necessarily deeded to him. a permit <br />was applied for he would have dete1l11ined that there was a problem, because that wasn't his land before <br />expended the money and energy to place those sheds on that propcrty. Testimony continued. <br /> <br />Mr. Henderson asked Mr. Pieski about mediation <br /> <br /> <br />the propeliy. <br /> <br />Mr. Pieski stated that was con-ect, that the HOA has proposed mediation and that they have accepted. Mr. <br />stated that hc would be willing to buy the propelty. Mr. Pieski is scheduled to submit their prefen'ed list of <br />mediators to the Board of Directors at thc 02/2008 mccting. <br /> <br />Discussion. <br /> <br />Mr. Ruf advised the Code Enforcement Board that the President of the Northshore HOA \vas present at the <br />hearing. <br /> <br />Discussion. <br />
