He also asked if <br />left hand side is the neighbor's fence and not this homeowner's fence. <br /> <br />Mr. Ruf stated that \vas COlTect. <br /> <br />Mr. Flint asked, the homeowner was pel111ittcd for a vinyl fence and not the chicken wire <br /> <br />Mr. Ruf stated that was correct. <br /> <br />Mr. Henderson asked \vl1o owns the property betwecl1 the two fences. <br /> <br />Ms. Toole-Lawrence stated the property between the two fences belongs to thc HOA. <br /> <br />Discussion. <br /> <br />Ms. Toole-Lawrence stated that in addition there was no pennit issued for thc side walls of this project, <br />either the City of CasselbeITY or the Florida Department of Environmental Protective Services. The only penl1its <br />provided were the wetlands regulations p0l1ion of this construction, as diagramed by Mr. Pieski in the <br />application with the information for the FDEP. Ms. Toole-Lawrence then refeITed to the project, for which Mr. <br />Pieski has approval for the sea\vall under this pem1it, however there is no approval for the side <br /> <br />Discussion. <br /> <br />Mr. Ruf stated that it is a wood wall, located on the east and west side of the property. <br /> <br />Discussion. <br /> <br />Ms. Toole-Lawrence stated that the presentation had ended and that the City was asking for a finding of non <br />compliance, for no Building Pemlit for the issues fence pemlit and the walls of the project <br />sheds. She then stated that Mr. Pieski was prescnt and would be presenting his own PowerPoint presentation. <br /> <br /> <br />Discussion. <br /> <br />David Pieski, property owner of945 Brydie gave testimony. The seawall is 40 ft wide, applied for 2004, <br />which took a year and a half working with the state to get the pemlit. Mr. Pieski then gave a background of his <br />experiences working with the City. In 2003 Mr. Pieski spoke with fonner planner Ben Griffith, he asked what <br />the City of Casselberry's permit requirements were. Mr. Griffith infonned Mr. Pieski that CasselbelTY was not <br />involved in the pem1itting at all, because North Lake Triplet is a navacable waterway. Mr. Griffith directed Mr. <br />Pieski to the St Johns water river management district, they were contacted in 2003. St. Johns said no, <br />Casselberry is wrong, it is the FDEP. Mr. Pieski then went to the FDEP and began the pem1itting process. <br />
