<br />CITY OF CASSELBERRY <br />CODE ENFORCEMENT BOARD MEETING <br />APRIL 10, 2008 PAGE 8 <br /> <br />Mr. Pusateri presented some other photos to the Board Members and eXplained them. <br /> <br />Discussion. <br /> <br />Robert C. Flint stated he didn't feel this vehicle resembled what the City Commissions intent was. Mr. Flint <br />continued. Mr. Flint didn't feel it was the intent to jeopardize the recreational use of car top carriers in the City of <br />Casselberry. <br /> <br />Phillip Weekley concurred with what Mr. Flint had just stated. Mr. Weekley continued. Mr. Weekley stated he was <br />glad this case was brought in, because this is the most minor infraction law you could get, this is good because it <br />gives a standard to start with since it is a new law. Mr. Weekley continued. <br /> <br />Discussion. <br /> <br />Mr. Pusateri thanked the Board Members tor their time. <br /> <br />Mr. Henderson stated there is an ordinance that says he can not have those on his truck unless he is going park his <br />truck in the garage or behind the house or where ever. <br /> <br />Mr. Flint stated that was not his interpretation of what the paragraph reads, this would be a personal interpretation. <br /> <br />Discussion. <br /> <br />Mr. Brown stated that the City was looking for some direction. <br /> <br />Discussion. <br /> <br />Mr. Brown stated that he was aware that the Board Members were not capable of striking down the Ordinance or <br />modifying it. Mr. Brown stated that he personally did not find the rack offensive either. There are discussions with <br />community development and they instructed Code Enforcement to enforce this particular type of vehicle which is <br />why we took action. Mr. Brown stated that Code Enforcement will take future enforcement action based on the <br />direction the Board gives at the 04/1 0/2008 Hearing. <br /> <br />Mr. Henderson stated that based on what was decided and what was told to Mr. Brown's group the vehicle is in <br />violation and once the Board starts distinguishing one vehicle from another they would open up Pandora's Box. The <br />gentleman carried his canoe for his grandchildren, uses it for recreational, but he also uses it for construction <br />purposes carrying ladders and such from time to time even though there is no signage. Mr. Henderson continued. <br /> <br />Mr. Flint stated he felt this is a matter of interpretation because he would consider an SUV that has racks on top to <br />be in the same condition as this vehicle here. <br /> <br />Discussion. <br /> <br />Mr. Brown gave testimony. <br />
