Conditional use request for alcoholic <br />beverage sales in a CG zoning district. Property located at 1870 State Road 436, Winter Park, Florida. <br /> <br />Mr. Charles Senzee, Planner, reviewed the information provided in his memorandum dated August 6, 2008, to <br /> <br />the City of Casselberry Planning and Zoning Commission (a copy is on file in the Community Development Department). <br /> <br />Mr. Senzee stated staff finds that the proposed structure is compatible with the surrounding land uses and will not change <br /> <br />the commercial nature of the property. The conditional use application meets all of the criteria for granting the conditional <br /> <br />use; therefore, City staff supports the request. Mr. Senzee said if the Planning and Zoning Commission approves CU 08- <br /> <br />09 to allow the on-site consumption of alcoholic beverages as allowed by the SRX state license, in conjunction with the <br /> <br />operation of a restaurant located at 1870 SR 436, it would be based on the findings of fact and conclusions of the staff <br /> <br />report dated August 6, 2008, and the conditions outlined in the staff report which were: <br /> <br />1. The conditional use shall be limited to the Orlando Roadhouse Comedy Grill restaurant located at 1810 SR <br />436. <br />2. All sales and consumption of alcoholic beverages shall be on-site and indoors. <br />3. Package sales of alcoholic beverages for off-site consumption are prohibited. <br />4. Hours of operation shall be Monday through Thursday, 11 :OOam-11 :OOpm, and Friday through Sunday, 11 :00 <br />am-2:00am. <br />5. The business shall remain in complete compliance with all City, County and State requirements. <br />6. There shall be no outside display or storage of goods, materials, services or vehicles. <br />7. The conditional use shall commence within 90 days of the approval. <br />8. The conditional use shall expire if the use is discontinued for more than 90 days. <br />9. All signage requires additional permit approval and must comply with all city requirements. <br />10. All of the above conditions shall be fully and faithfully executed or the conditional use shall become null and <br />void. <br /> <br />A brief discussion ensued regarding condition number 6 regarding outside storage of vehicles. Mr. Senzee said <br /> <br />the restriction for unlicensed and inoperable vehicles could be added to the conditions of approval. <br /> <br />Mr. Buchanan asked the applicant to come forward. Mr. Walter Huffmann, 524 Lazy Oaks Drive, Winter Park, <br /> <br />Florida came forward. In response to the Commission's question, Mr. Huffmann said he has read the staff report and <br /> <br />understands the recommendations outlined by staff. <br /> <br />Mr. Huffmann said the truck shell stored on the property was included in the sale of the business and it will be <br /> <br />removed on Friday along with the construction debris. He said they have worked with the Code Enforcement Department <br /> <br />to address any code violations and will continue to do so in the future. <br />
