<br />AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, AMENDING
<br />CHAPTER 2, ADMINISTRATION, ARTICLE II, CITY COMMISSION,
<br />DIVISION 1, GENERALLY, SECTION 2-36, ELECTION OF MEMBERS OF
<br />THE CITY COMMISSION, OF THE CITY CODE OF ORDINANCES; TO
<br />MODIFY LANGUAGE IN SECTION 2-36(B)(1) REGARDING RUN-OFF
<br />ELECTION AND TIE VOTES TO BE CONSISTENT WITH CITY CHARTER
<br />SECTION 38, RUN-OFF ELECTION AND CERTIFICATION OF ELECTION;
<br />CREATING SECTION 2 - 35, ELECTION PROCEDURES, IN CHAPTER 2,
<br />ADMINISTRATION, ARTICLE II, CITY COMMISSION, DIVISION 1,
<br />GENERALLY, OF THE CITY CODE OF ORDINANCES TO BE CONSISTENT
<br />WITH CITY CHARTER SECTION 37, ELECTION PROCEDURES;
<br />PROVIDING FOR CONFLICTS, SEVERABILITY, CODIFICATION, AND
<br />EFFECTIVE DATE.
<br />
<br />WHEREAS, the electors approved City Charter Amendment 2 on January 29,
<br />2008, and it is now effective, as set forth in Ordinance 07-1214; and
<br />
<br />WHEREAS, as a result of the passage of City Charter Amendment 2, City
<br />Charter Section 38, Run-off Election and Certification of Election, was modified
<br />changing the election system requiring a simple majority of votes to requiring a majority
<br />plus one; and
<br />
<br />WHEREAS, the change to the election system requiring a majority plus one may
<br />cause the need for a run-off election; and
<br />
<br />WHEREAS, the change to the election system requiring a majority plus one also
<br />modified procedures to follow in the event of a tie vote; and
<br />
<br />WHEREAS, the City Commission finds it necessary to modify language
<br />contained in Section 2-36, Election of Members of City Commission, of the City Code of
<br />Ordinances, to be consistent with City Charter Section 38, Run-Off Election and
<br />Certification of Election; and
<br />
<br />WHEREAS, City Charter Section 37 states that the City Commission shall
<br />establish election procedures by ordinance; and
<br />
<br />WHEREAS, words with double underlined type shall constitute additions to the
<br />original text and strike throligk shall constitute deletions to the original text of Section 2-
<br />36, Election of Members of City Commission, and Section 2-35, Election Procedures, of
<br />the City Code of Ordinances.

<br />NOW, THEREFORE, BE IT ENACTED BY THE COMMISSION
<br />OF THE CITY OF CASSELBERRY, FLORIDA, AS
