Ordinance 08-1237 - Amend ULDR Section 3-16, Signs, Electronic Message Boards <br />(LPA 07-08) <br /> <br />The City Clerk read Ordinance 08-1237 by title as follows: <br /> <br />"AN ORDINANCE AMENDING CERTAIN PROVISIONS OF ARTICLE XVI OF THE <br />CITY OF CASSELBERRY UNIFIED LAND DEVELOPMENT REGULATIONS <br />RELATING TO SIGNS: AMENDING SECTION 3-16.2, DEFINITIONS, TO REVISE <br />DEFINITION OF ANIMATED SIGNS AND TO ADD A DEFINITION FOR <br />ELECTRONIC DISPLAY TYPE SIGNS: AMENDING SECTION 3-16.8, PROHIBITED <br />SIGNS, TO PROHIBIT SIGNS WITH DISTRACTING LIGHTING: AMENDING 3-16.9 <br />TO CLARIFY PROHIBITION ON INCREASES IN NON-CONFORMING SIGNS, AND <br />TO PROVIDE AN AMORTIZATION SCHEDULE: REPEALING SECTIONS 3.26.7(D) <br />AND 333-16.10(G), AND RENUMBERING 3-16.7(E): ADDING SECTION 3-16.13, <br />APPEALS TO BOARD OF ADJUSTMENT: SECTION 3-16.14, APPELLATE <br />DECISIONS DEEMED FINAL SUBJECT TO REVIEW: SECTION 3-16.15, <br />SUBSTITUTION OF NON-COMMERCIAL SPEECH FOR COMMERCIAL SPEECH; <br />SECTION 3-16.16, CONTENT NEUTRALITY AS TO SIGN MESSAGE; 3-17.17, <br />PROVIDING FOR SEVERABILITY, CODIFICATION, CONFLICTS AND EFFECTIVE <br />DATE." <br /> <br />Staff Presentation: The City Manager requested this item be continued to the March 10, 2008 <br />meeting due to a glitch in the required advertising for this ordinance. <br /> <br />Audience Input: The City Attorney stated that the public should be given an opportunity to <br />speak since it was on the Agenda. The following individual came forward: <br /> <br />L Matt Myre, 624 Kendall Way, Casselberry, Florida, as a small business owner in <br />Casselberry spoke in opposition to Ordinance 08-1237. He stated that digital signs could be an <br />enhancement to the community and the business community. <br /> <br />2. Harold Stewart, 229 Park Maitland Court, Casselberry, Florida, stated that he did not <br />have any problems with digital signs and they are crucial to the small business owners in the <br />community, but he did have a problem with electronic billboards. <br /> <br />B. Ordinance 08-1238 - Amendments to Ordinance 07-1215 - Parking in Residential <br />Districts/Recreational Equipment <br /> <br />MOTION: <br /> <br />Moved by Commissioner Susan Doerner to coutinue Ordinance <br />08-1238 to the March 10, 2008 Meetiug to incorporate <br />changes discussed at the Work Session. Motion was <br />seconded by Commissioner Jou Miller and carried <br />unanimously on a 4 - 0 voice vote. <br />
