<br />CITY OF CASSELBERRY <br />COMPREHENSIVE PLAN <br /> <br />PUBLIC SCHOOLS FACILITY ELEMENT <br /> <br />CHAPTER XII - PUBLIC SCHOOLS ELEMENT <br /> <br />A. INTRODUCTION <br /> <br />The City of Casselberty recognizes the benefits that will flow to the citizens and students of its <br />communities by providing adequate public school facilities in a timely manner. To this end, the <br />Seminole County School Board, the Seminole County Board of County Commissioners and seven <br />municipalities, including the City of Casselberry, entered into an Interlocal Agreement, which is <br />attached as Appendix A, addressing the coordination of public school facility and comprehensive <br />land use planning (as required by Sections 163.3177 and 1013.33 FS.). <br /> <br />A staff working group, the School Planning Technical Advisory Committee (SPT AC), comprised of <br />staff representing each of the signatories to the agreement was created to discuss and develop <br />recommendations regarding the coordination of land use and school facilities planning. The specific <br />areas of concern identified by SPT AC include population and student projections, development <br />trends, school needs, co-location and joint use opportunities, and infrastructure improvements <br />needed to support schools and safe student access. <br /> <br />In addition to the SPT AC, a Public School Facilities Planning Committee (pSFPC), comprised of <br />elected officials and their designees, was formed to review and put forward recommendations from <br />the PT AC. The committees will meet several times annually and report to the participating <br />municipalities, the School Board and the County as well as the general public. The meetings will be <br />advertised to the public with an opportunity for public participation. <br /> <br />1. Purpose <br /> <br />Legislation enacted by the 2005 Florida Legislature mandates a comprehensive focus on <br />school planning by requiring local governments and school boards to adopt a school <br />concurrency system. School concurrency ensures coordination between local governments <br />and school boards in planning and permitting developments that affect school capacity and <br />utilization rates. The legislation also required inclusion of a Public School Facilities Element <br />in all Florida jurisdiction Comprehensive Plans. The City of Casselberry has a deadline of <br />2008 to adopt the new required element into its Plan. <br /> <br />2. Element Requirements <br /> <br />With the passage of Senate Bill 360, the inclusion of a Public School Facilities Element and <br />school concurrency are no longer optional. The following sections of Chapter 163, Part II, <br />F.S., should be interpreted as a whole rather than individually. To implement school <br />concurrency, local governments and school boards are required to: <br /> <br />· Prepare a public school Interlocal Agreement and the Intergovernmental <br />Coordination Element to include coordinated procedures for implementing school <br />concurrency (Sections ]63.3177(6)(h)(1), )(,3.31777 F.S. and 163.318()(131, F.S.; <br /> <br />. Adopt a Public School Facilities Element into the Comprehensive Plan (Sections <br />163.3180(1.1)(.1 and ]63.3177(12), F.S., and Rule 91-5.025, F.A.C); <br /> <br />XII-l <br />
