MOTION: Moved by Vice Mayor/Commissioner Susan Doerner to approve the Consent Agenda as presented. Motion was seconded by Commissioner Jon Miller and carried unanimously. (5 - 0) 9. Public Hearings: A. Second Reading of Ordinance 07-1212 - Anchor Road Annexation A request for continuance of Ordinance 07-1212 to July 23,2007 was submitted to allow additional time for the City and Seminole County to develop an agreement regarding the annexation dispute. The applicant agrees with the continuance. MOTION: Moved by Vice Mayor/Commissioner Susan Doerner to continue the public hearing regarding Ordinance 07-1212, Anchor Road Annexation, to July 23, 2007, as requested. Motion was seconded by Commissioner Colleen S. Hufford and carried unanimously. (5 - 0) 10. First Reading of Ordinances: A. Ordinance 07-1216 - Amendments City Code Chapter 42 Open Burning The City Clerk read Ordinance 07-1216 by title as follows: "AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, AMENDING CHAPTER 42, FIRE PROTECTION AND PREVENTION, SECTION 42-4, OPEN BURNING, TO PROHIBIT ALL OPEN BURNING EXCEPT AS SPECIFICALLY PROVIDED; PROVIDING FOR SEVERABILITY, CODIFICATION, CONFLICTS AND EFFECTIVE DATE." Staff Presentation: Ordinance 07-1216 was initiated due to complaints from citizens because of dry conditions, air pollution and endangerment to citizens and property. The ordinance amends Chapter 42, Section 42-2, Open Burning and prohibits all open burning within the City, except for fire training or prescribed burns conducted by the Fire Department or the State Division of Forestry. Staff Recommendation: Staff recommended Ordinance 07-1216 be amended to allow open burning in non-residential districts if a permit is obtained and approved by the Fire Chief, i.e ceremonial fires, religious fires, recreational fires, outdoor commercial cooking fires and outdoor heating or lighting devices. The types of burning that do not require pre-approval by the Fire Chief are burning in kilns, ovens or similarly regulated devices, chimeneas/frre bowls, outdoor fireplace, patio heaters, cooking fires and warming fires conducted at work sites. Commission consensus was to approve Ordinance 07-1216 on first reading with the recommended changes authorizing the City Attorney to refine the ordinance using definitions as set forth in the Florida Administrative Code and bring back for public hearing on August 13, 2007.
