Motion was seconded by Commissioner <br />Jon Miller and carried unanimously. (5 - 0) <br /> <br />9. Public Hearings: <br /> <br />A. Second Reading of Ordinance 07-1212 - Anchor Road Annexation <br /> <br />A request for continuance of Ordinance 07-1212 to July 23,2007 was submitted to allow additional <br />time for the City and Seminole County to develop an agreement regarding the annexation dispute. <br />The applicant agrees with the continuance. <br /> <br />MOTION: <br /> <br />Moved by Vice Mayor/Commissioner Susan Doerner to continue the <br />public hearing regarding Ordinance 07-1212, Anchor Road Annexation, <br />to July 23, 2007, as requested. Motion was seconded by Commissioner <br />Colleen S. Hufford and carried unanimously. (5 - 0) <br /> <br />10. First Reading of Ordinances: <br /> <br />A. Ordinance 07-1216 - Amendments City Code Chapter 42 Open Burning <br /> <br />The City Clerk read Ordinance 07-1216 by title as follows: <br /> <br />"AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, AMENDING CHAPTER <br />42, FIRE PROTECTION AND PREVENTION, SECTION 42-4, OPEN BURNING, TO <br />PROHIBIT ALL OPEN BURNING EXCEPT AS SPECIFICALLY PROVIDED; PROVIDING <br />FOR SEVERABILITY, CODIFICATION, CONFLICTS AND EFFECTIVE DATE." <br /> <br />Staff Presentation: Ordinance 07-1216 was initiated due to complaints from citizens because of dry <br />conditions, air pollution and endangerment to citizens and property. The ordinance amends Chapter <br />42, Section 42-2, Open Burning and prohibits all open burning within the City, except for fire <br />training or prescribed burns conducted by the Fire Department or the State Division of Forestry. <br /> <br />Staff Recommendation: Staff recommended Ordinance 07-1216 be amended to allow open burning <br />in non-residential districts if a permit is obtained and approved by the Fire Chief, i.e ceremonial fires, <br />religious fires, recreational fires, outdoor commercial cooking fires and outdoor heating or lighting <br />devices. The types of burning that do not require pre-approval by the Fire Chief are burning in kilns, <br />ovens or similarly regulated devices, chimeneas/frre bowls, outdoor fireplace, patio heaters, cooking <br />fires and warming fires conducted at work sites. <br /> <br />Commission consensus was to approve Ordinance 07-1216 on first reading with the recommended <br />changes authorizing the City Attorney to refine the ordinance using definitions as set forth in the <br />Florida Administrative Code and bring back for public hearing on August 13, 2007. <br />
