<br />CASSELBERRY CITY COMMISSION <br />Minutes of March 25, 2002 - Regular Meeting <br />Page 7 of 19 <br /> <br />NOTIFICATION, AND PENALTIES; AMENDING SUBSECTION 0, GLARE AND <br />LIGHTING STANDARDS FOR NUISANCE ABATEMENT, OF ARTICLE XVII, <br />NUISANCE ABATEMENT OF CHAPTER III, PERFORMANCE CRITERIA TO <br />REFERENCE NEW LIGHTING STANDARDS; AMENDING SUBSECTION B.2C(ii), <br />PROPOSED OF SECTION 4-19.3, INFORMATION TO BE INCLUDED IN SITE PLAN, <br />OF ARTICLE XVIII, SITE PLAN REVIEW, OF CHAPTER IV, SPECIFIC <br />DEVELOPMENT PROCEDURES, TO REFERENCE PHOTOMETRIC PLAN <br />GUIDELINES; AMENDING SUBSECTION V (20), STREET LIGHTING, OF SECTION <br />4-19.2, REQUIRED IMPROVEMENTS AND DESIGN CRITERIA, OF ARTICLE XIX, <br />SUBDIVISION, OF CHAPTER IV, SPECIFIC DEVELOPMENT PROCEDURES, TO <br />REFERENCE PHOTOMETRIC GUIDELINES AND LIGHT POLE LOCATION; <br />PROVIDING FOR SEVERABILITY, CODIFICATION, CONFLICTS AND EFFECTIVE <br />DATE." <br /> <br />Mr. Wells stated Ordinance 02-1046 provides for an exterior lighting code to limit the amount of light that <br />may be used to illuminate a commercial site, and will require businesses to meet the new code after a five- <br />year amortization period. The Planning & Zoning Commission/Local Plam1ing Agency reviewed and <br />recommended approval of Ordinance 02-1 046 at its February 27,2002 meeting by a vote of 6 - O. The City <br />Attorney and staffreconID1ended approval of Ordinance 02-1046 on first reading. <br /> <br />Mr. Wells recommended the following modification to Ordinance 02-1046; <br /> <br />Page 13, Section 3 (ii) delete "value" and insert "candle level" <br /> <br />Mayor Pronovost asked if there was anyone in the audience that wished to speak either for or against <br />Ordinance 02-1046. The following individuals came forward: <br /> <br />I) Lurent Pellerin, 674 North Cliff Avenue, Deltona, Chairman of the Dark Sky Advisory <br />COllID1ittee for the Central Florida Astronomical Society, stated he has been working with <br />staff on the Exterior Lighting Standards Ordinance. Mr. Pellerin said exterior lighting <br />standards have been adopted by numerous public entities locally as well as worldwide <br />recently and gave some background information regarding illumination guidelines and <br />safety issues. Mr. Pellerin was in favor of Ordinance 02-1046 stating it will provide costs <br />savings on electricity, reduction in glare which improves safety, and a reduction in sky- <br />glow, while providing more uniform lighting rather than hot spots. <br /> <br />2) Phyllis Sheppard, 580 South Triplet Lake Drive, came forward and gave examples of <br />prior light spillover problems from the golf course driving range and the Secret Lake Park <br />ballfield onto nearby residential areas. <br /> <br />No one else came forward. Mayor Pronovost closed the public hearing. <br /> <br />Commissioner Sheppard voiced concerns about the lack of controls on residential lighting and requested that <br />lighting spillover beyond someone's residential property line be specifically addressed. Mr. Wells stated <br />currently any residential lighting issues are addressed through the general nuisance code. City COlllillission <br />consensus was to direct staff to research and explore possible residential lighting regulations. Mayor <br />Pronovost suggested staff request input from Mr. Pellerin on the matter as well. Mrs. Reischmann stated the <br />expert involved in the preparation of Ordinance 02-1046 had narrowed the scope of the ordinance from <br />including residential to only addressing conID1ercial, so it would be helpful to also approach that expert for <br />further assistance on the residential lighting issue. <br />
