Motion passed 5 - O. <br /> <br />V. SECOND READING OF ORDINANCE 02-1049 - ANNEXATION OF <br />MIDDLETON AREA PROPERTIES <br /> <br />MOTION: <br /> <br />Commissioner Clark moved to read Ordinance 02-1049 <br />by title only. Motion was seconded by Commissioner <br />Henson. Motion carried unanimously by voice vote. <br /> <br />The City Clerk read Ordinance 02-1049 by title as follows: <br /> <br />"AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, RELATING TO <br />ANNEXATION; MAKING FINDINGS; ANNEXING TO AND INCLUDING WITHIN <br />THE CORPORATE LIMITS OF THE CITY OF CASSELBERRY, FLORIDA, CERTAIN <br />LANDS LOCATED IN SECTIONS 4 AND 5, TOWNSHIP 21S, RANGE 30E; <br />REDEFINING THE CORPORATE LIMITS OF THE CITY OF CASSELBERRY, <br />FLORIDA; PROVIDING FOR THE INTERIM PROVISION OF LAND DEVELOPMENT <br />REGULATIONS; PROVIDING THAT CERTAIN COUNTY LICENSEES FOLLOWING <br />THEIR BUSINESS, TRADE OR PROFESSION WITHIN THE LANDS TO BE <br />ANNEXED MAY CONTINUE TO FOLLOW SUCH BUSINESS, TRADE OR <br />PROFESSION THROUGHOUT THE ENTIRE CORPORATE LIMITS WITHOUT THE <br />NECESSITY OF FURTHER QUALIFICATION THEREFORE; PROVIDING THAT <br />EFFECTIVE IN ACCORDANCE WITH LAW, THE LANDS TO BE ANNEXED SHALL <br />BE ASSESSED FORP A YMENTOF MUNICIPAL AD VALOREM TAXES; DIRECTING <br />THE CITY CLERK TO FILE CERTIFIED COPIES OF THE ORDINANCE WITH THE <br />CLERK OF COURT AND THE SECRETARY OF STATE OF THE STATE OF <br />FLORIDA; AND PROVIDING FOR CODIFICATION, CONFLICTS, SEVERABILITY, <br />AND EFFECTIVE DATE." <br /> <br />The Notice of Public Hearing relative to Ordinance 02-1049 was published in the Orlando Sentinel on April <br />28, 2002 and May 5, 2002. Ordinance 02-1049 was passed on first reading on April 8, 2002. <br /> <br />Commissioner Clark disclosed that as a real estate broker he was instrumental in putting the Middleton Area <br />properties together and did receive compensation for his services, therefore he would be abstaining from <br />action on Ordinance 02-1049. (Commissioner Clark's completed Form 8B, Memorandum of Voting <br />Conflict for County, Municipal, and Other Local Public Officers is attached to and made a part of <br />these minutes.) <br /> <br />Mr. Wells stated Ordinance 02-1049 provides for annexation of properties in the vicinity of the Middleton <br />Pest Control property on the east side of US 17-92 near the intersection of Lake Kathryn Circle and 17-92, <br />including petitions for properties owned by Gregory Hopcraft and the Florida Department of Transportation. <br />
