RESOLUTION 07-1773 - FIRST AMENDMENT TO THE SALE AND <br />PURCHASE CONTRACT BETWEEN THE CITY OF CASSELBERRY AND <br />CRF-MAITLAND. LLC <br /> <br />The City Clerk read Resolution 07-1773 by title as follows: <br /> <br />"A RESOLUTION OF THE CITY OF CASSELBERRY, FLORIDA, AUTHORIZING THE <br />MAYOR TO EXECUTE THE FIRST AMENDMENT TO THE SALE AND PURCHASE <br />CONTRACT BETWEEN THE CITY OF CASSELBERRY ANDCRF-MAITLAND, LLC; <br />PROVIDING FOR CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE." <br /> <br />Staff Presentation: Mr. Ed Torres, Public Works Director, stated Resolution 07-1773 provides for the First <br />Amendment to the sale and purchase contract between the City and CRF-Maitland, LLC, which is in <br />conjunction with the proposed intersection improvements at U.S. Highway 17-92 and Plumosa Avenue. The <br />City Attorney has indicated there are title issues that CRF-Maitland, LLC needs to address prior closing and <br />necessitate an extension of the closing date to occur on or before May 15, 2007. The original contract was <br />approved via Resolution 07-1761 on February 12,2007. <br /> <br />Budget Impact: This item has no budget impact. <br /> <br />Recommendation: The City Manager and the Public Works Director recommended approval of Resolution <br />07-1773 as presented. <br /> <br />Audience Participation: The following individual requested an opportunity to address Resolution 07-1773: <br /> <br />I) John Casselberry, 700 South Lost Lake Lane, inquired ifthis contract involves the Home Depot property, <br />stating it would be a good time to clear the shoreline of Lake Concord located on that property at the same <br />time of this realignment project. Mr. Casselberry also recommended the roadway should extend east out to <br />Sunset Drive to improve traffic flow patterns in the area. <br /> <br />MOTION: <br /> <br />Vice Mayor Doerner moved to approve Resolution 07- <br />1773, as presented. Motion was seconded by <br />Commissioner Solomon. Motion carried unanimously <br />by voice vote 5 - O. <br /> <br />D.
