<br />Sec. 31. Time and place of City election. <br /> <br />Election of the Mayor/Commissioner and City Commission members shall be the same <br />time as the State primarY election or the Tuesday ten (10) weeks prior to the e:eneral election. if <br />no primarY is held. heM eB TlIesaay after the RfSt MaBeay iB ))evemller. Such election shall be <br />known as the City election of the City of Casselberry, Florida, within the City for all purposes. <br />Voting places shall be determined by the City Commission at either a regular or special meeting. <br /> <br />* * * <br /> <br />Sec. 38. Run-off election and Certification of election. <br /> <br />The candidate for an office receiving the highest ffiIffiller maiority of votes cast shall be <br />elected. If there should be more <br />than two candidates for anv office and no one candidate receives a maiority of the votes cast in <br />the municipal election held pursuant to Section 31. or in the event of a tie vote. then the two <br />candidates receiving the hil!:hest votes in the first election shall run again in a run-off election to <br />be held on the Tuesdav after the first Monday in November. The run-off election shall be held in <br />the same manner as the prior election. The candidate receivine: the maiority of the votes cast at <br />such run-off election shall be elected. In the event of a tie vote at the run-off election. the tie will <br />be dissolved by a lotterv pursuant to state statute. The City Commission, upon confirmation of <br />the returns of the election, shall certify the officers elected and issue certificates of office <br />accordingly. <br /> <br />SECTION 4. The City Clerk is hereby directed to ensure that all advertising, translation <br />and notice requirements are complied with and to coordinate all activities necessary to conduct <br />the referendum election called in Section I ofthis Ordinance with the Supervisor of Elections for <br />Seminole County. <br /> <br />SECTION 5. The proposed amendments, the ballot titles and the wording of the <br />substance of the proposed amendments to the Charter, as contained in this Ordinance, shall <br />appear on the ballot in the form of questions as set forth in Section 2 of this Ordinance. <br /> <br />SECTION 6. Transition Assumine: Approval bv Referendum of Amendments to <br />Article VII. Sections 31 and 38 of the Charter. In accordance with Section 67 of the Charter <br />allowing for transitional terms for incumbent officers, incumbent officers holding office at the <br />time Sections 31 and 38 of the Charter are amended shall continue to hold office until the <br />expiration of their full four year terms. Accordingly, if the incumbent's term expires in 2008, <br />said incumbent shall hold office until November of 2008. If the incumbent's term expires in <br />2010, said incumbent shall hold office until November of 2010. Newly elected <br />Mayor/Commissioners shall not be seated until November of 2008 or November of 2010, <br />whichever is applicable, regardless of when the election results are certified.
