<br />City Commission <br />March 20, 1995 <br />Page 2 <br /> <br />The City Clerk read Ordinance 95-820 by title as follows: <br /> <br />"AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, AMENDING <br />CHAPTER 94 OF THE CODE OF ORDINANCES OF THE CITY OF CASSELBERRY, <br />FLORIDA, TO AMEND THE ANNUAL REGISTRATION FEE: REGULATING THE <br />SPEED OF BOATS AND PERSONAL WATERCRAFTS; PROVIDING FOR PENALTY <br />FOR VIOLATION OF REGULATIONS; PROVIDING FOR CODIF1CATION, <br />CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE." <br /> <br />The Public Hearing Notice for Ordinance 95-820 was published in the Orlando Sentinel on <br />Friday, March 10,1995 asrequired byF.S. 166.041(3)(a). <br /> <br />Matthew Fortini, Parks and Recreation Director, presented Ordinance 95-820 for second <br />reading with changes made by the Commission at first reading regarding time changes and <br />registration fees. In addition, changes in the language with regard to the penalty section <br />and the enforcement section have been incorporated in Code Section 94 with sections of <br />the Florida Statutes that will give the police department the authority to issue uniform <br />boating citations for speed restrictions and other violations. Mr. Fortini said the Florida <br />Marine Patrol has tentatively approved the draft of Ordinance 95-820 as suitable and <br />enforceable. <br /> <br />Ken McIntosh, City Attorney suggested that adding a seventh whereas clause as follows: <br /> <br />"WHEREAS the City Commission of the City of Casselberry, Florida, <br />finds it is in the best interest of the health, safety and general welfare of <br />the citizens of Casselberry that the registration fee provision in the Code <br />be amended to determine the ownership of all watercraft which operate <br />on the waters of the City of Casselberry in the advancement of water <br />safety. <br /> <br />Section V should be corrected so as to be gender perfect. (hislher) <br /> <br />Addition Violation Section - "Violation of Section 94.40 and 94.43 will <br />be subject to penalties as provided in Florida Statutes 327.72 (if applicable) <br />327.73 and 327.74. <br /> <br />Mr. McIntosh said the minor changes would not alter substance of Ordinance 95-820 as <br />previously identified in the Notice of Public Hearing. <br /> <br />Jack Schluckebier, City Manager, recommended the effective date of the ordinance be <br />June 1, 1995 to give staff ample time to set the program in place i.e., training on police <br />equipment, specifications of new routines and clearance from the State. <br />
