<br />RESOLUTION 07-1781 <br /> <br />"A RESOLUTION OF THE CITY OF CASSELBERRY, FLORIDA, AUTHORIZING THE <br />EXECUTION OF A PURCHASE AGREEMENT AND TEMPORARY ACCESS LICENSE <br />BETWEEN KAREN KILGANNON AND THE CITY OF CASSELBERRY; PROVIDING <br />FOR CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE." <br /> <br />WHEREAS, the City of Casselberry desires to obtain two separate identified parcel(s) from Karen <br />Kilgannon, (via Fee Simple Warranty Deed), and a Temporary Construction Easement, located at the <br />intersection of Melody Lane and II Jackson Court; and <br /> <br />WHEREAS, these two parcels are required for additional road right-of-way and Temporary <br />Construction Easement to construct the Melody Lane roundabout infrastructure improvements associated <br />with the Triplet Lake Drive and US Highway 17/92 Intersection Improvements Project; and <br /> <br />WHEREAS, Karen Kilgannon has agreed to provide a Temporary Access License to the City of <br />Casselberry, in order for the City to begin construction activities prior to the closing date for acquiring said <br />parcels; and <br /> <br />WHEREAS, City staff and the City Attorney have reviewed the Purchase Agreement and <br />Temporary Access License between Karen Kilgannon and the City of Casselberry and finds them favorable <br />to the City. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF <br />CASSELBERRY, FLORIDA, AS FOLLOWS: <br /> <br />SECTION I. The City Commission of the City of Casselberry hereby approves the agreement for <br />the purchase of property and Temporary Access License between Karen Kilgannon and the City of <br />Casselberry (attached hereto as "Attachments A and B"), and authorizes the Mayor to execute said <br />documents on behalf of the City. <br /> <br />SECTION II. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the <br />provisions of this Resolution are hereby repealed. <br /> <br />SECTION III. Severabilitv. If any Section or portion of a Section of this Resolution proves to be <br />invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, or effect <br />of any other Section or part ofthis Resolution. <br /> <br />SECTION IV. Effective Date.
