<br />5. Survey. A boundary survey showing easements, encroachments and other <br />restrictions that could affect the City's proposed use. The survey shall be <br />certified to the Seller, Buyer (the City), the title company, the mortgagor (if <br />applicable) and the City's Attorney. <br /> <br />6. Land use Approval. Land use approval, if needed, should be obtained <br />before purchase, if possible. <br /> <br />7. Recordation. As soon as practicable after closing, but in no event more than <br />14 days after closing has occurred. <br /> <br />Any of the above conditions that cannot reasonably be met may be waived upon <br />authorization of the City Commission. <br /> <br />III. PERMANENT EASEMENTS: * <br /> <br />The following are the necessary actions before a permanent easement may be accepted: <br /> <br />1. If under $5,000: <br /> <br />A Title search/commitment. A title search and/or commitment to be <br />performed by the City Attorney. After review of the title search the <br />City Attorney may determine that title insurance is unnecessary. <br /> <br />B. Subordination/Mortqaqee Approval. On all easements the staff <br />should submit the easement to the City Attorney for review to <br />determine if a subordination agreement is necessary or mortgagee <br />approval is necessary. <br /> <br />C. Recordation. As soon as practicable after closing, but in no event <br />more than 14 days after closing has occurred. <br /> <br />2. If greater than $5,000: <br /> <br />A Title search/commitment. A title search and/or commitment to be <br />performed by the City Attorney.
