Box 4848 <br />Sanford, FL 32772-4848 <br /> <br />UTILITY COMMITMENT AGREEMENT <br /> <br />THIS UTILITY COMMITMENT AGREEMENT ("Agreement") is made this _ day of <br />October, 2005, between ExxonMobil Oil Corporation, a New York corporation whose address is <br />3225 Gallows Road, Fairfax, Virginia 22037 (the "Developer"), and the CITY OF CASSELBERRY, <br />FLORIDA, a Florida municipality, whose address is 95 Triplet Lake Drive, Casselberry, Florida <br />32707 (the "City"). <br /> <br />RECITALS <br /> <br />WHEREAS, Developer is the developer of that certain real property located in Casselberry, <br />Florida, more particularly described as set forth on Exhibit "A" attached hereto and incorporated <br />herein by this reference (the "Property"); <br /> <br />WHEREAS, Developer desires to develop the Property for use as a gasoline and convenience <br />store and car wash (the "Project"); <br /> <br />WHEREAS, the City is authorized to regulate the development of the Property pursuant to <br />governmental regulations; <br /> <br />WHEREAS, Developer has agreed to permit and build a gravity sanitary sewer system <br />subject to partial reimbursement by the City for those portions of the gravity sewer not required to <br />serve the Project only, and the Developer and the City desire to set forth and memorialize the various <br />conditions, development standards and other obligations imposed by the City and other conditions <br />applicable to the proposed development of the Property; and <br /> <br />WHEREAS, this Agreement is consistent with the City's Comprehensive Plan as indicated <br />on the Official City of Casselberry Zoning Map Adopted August 13,2001, revised September 24, <br />2004; and the City of Casselberry Future Land Use map Revised September 24, 2004. <br /> <br />1 <br />
