<br />RESOLUTION 06-1650 <br /> <br />"A RESOLUTION OF THE CITY OF CASSELBERRY, FLORIDA, AUTHORIZING THE <br />EXECUTION OF AN AGREEMENT WITH EXXONMOBIL OIL CORPORATION FOR <br />PARTIAL REIMBURSEMENT OF THE COST FOR CONSTRUCTION OF A SANITARY <br />SEWER SYSTEM TO SERVE FUTURE CONNECTIONS; PROVIDING FOR CONFLICTS, <br />SEVERABILITY, AND EFFECTIVE DATE." <br /> <br />WHEREAS, ExxonMobil Oil Corporation is the owner and developer of that certain real <br />property located at the southeast corner of North Winter Park Drive and Seminola Boulevard; and <br /> <br />WHEREAS, said parcel is located within the limits of the Seminola Boulevard Sanitary <br />Sewerage Study Area; and <br /> <br />WHEREAS, ExxonMobil has agreed to permit and build an extension of the sanitary sewer <br />system beyond that required for service to its development in order to facilitate the construction of <br />the City's proposed Seminola Boulevard Sanitary Sewer System; and <br /> <br />WHEREAS, the City staff has reviewed the construction costs and proposed Utility <br />Commitment Agreement and recommends that the City of Casselberry enter into said Agreement. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF <br />CASSELBERRY, FLORIDA, AS FOLLOWS: <br /> <br />SECTION I. The City Commission of the City of Casselberry hereby approves the Utility <br />Commitment Agreement with ExxonMobil Oil Corporation (attached hereto as "Attachment A"), and <br />authorizes the Mayor to execute said document on behalf of the City. <br /> <br />SECTION II. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the <br />provisions of this Resolution are hereby repealed. <br /> <br />SECTION III. Severabilitv. If any Section or portion of a Section of this Resolution proves to <br />be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, or <br />effect of any other Section or part of this Resolution. <br /> <br />SECTION IV. Effective Date.
