ARTICLE 5
WORK STOPPAGES

5.1 There shall be no strikes, lockouts, work stoppages, slowdowns, mass resignations, sick-
outs, picketing that blocks the ingress or egress to property, or other job actions or refusal to
perform assigned work by the employees covered under this Agreement.

5.2. The parties agree that any employee who participates in or promotes any of the
aforementioned activities may be discharged or otherwise disciplined by the City. Nothing
herein shall restrict the City from levying different disciplinary actions against different
employees based on their involvement in activities prohibited hereunder.

5.3. The Union recognizes that the City and the employees covered hereunder are responsible
for and engaged in activities which are the basis of the health and welfare of the City's citizens
and that, therefore, any violation of this Article would give rise to irreparable damage to the City
and the public at large. For the purpose of this Article, it is agreed that the Union shall be
responsible and liable for any act by its agents, representatives, and/or officers, which act
constitutes a violation of this Article, unless the Union has publicly disavowed such action and
publicly demands its cessation.

6
