<br />ARTICLE 11 <br />UNION BUSINESS <br /> <br />11.1 Nothing contained in this Collective Bargaining Agreement shall preclude any employee <br />covered by this Agreement from pursuing any right or remedy available under this Agreement <br />without representation of the Union. Further, nothing contained in this Agreement shall preclude <br />any employee from discussing a problem directly with his immediate non-bargaining unit <br />supervisor or any other Departmental official without the intervention of the Union; provided, <br />however, that such non-bargaining unit supervisor or other Departmental official is agreeable to <br />having such discussion. Any resolution made by an employee covered hereunder with his non- <br />bargaining unit supervisor shall not set a precedent for the settlement of any other disagreement <br />involving the same or other employees. <br /> <br />11.2 The City shall recognize one (1) Union representative to represent the bargaining unit <br />Lieutenants. The identity of the Union representative shall be furnished in writing to the <br />Personnel Director and the Police Chief prior to the effective date of the Union representative <br />assuming hislher duties. Prompt written notification of changes in the Union representative shall <br />be provided to the Personnel Director and the Police Chief. No Union representative will be <br />recognized by the City unless such written notification was presented prior to such Union <br />representative assuming hislher duties. <br /> <br />11.3 The Union representative shall be paid by the City only when he/she performs assigned <br />law enforcement duties and/or work directed by the City. To the extent that this employee <br />wishes to perform Union duties (such as negotiations, grievance processing, attending Union <br />conventions, etc.) during his/her normal work schedule, he/she may utilize annual leave; <br />provided, however, that he/she complies with the rules otherwise applicable to annual leave. <br /> <br />15 <br />
