<br />£Xl¡·h" <br />Ft <br /> <br />RESOLUTION C4-1 <br /> <br />A RESOLUTION OF THE COUNCIL OF LOCAL GOVERNMENTS IN <br />SEMINOLE COUNTY PROVIDING FOR A SUGGESTED AMENDMENT TO <br />FLORIDA STATUTE § 23.127(1), FLA. STAT., TO ALLOW LAW <br />ENFORCEMENT OFFICERS TO ENFORCE TRAFFIC LAWS OUTSIDE THE <br />OFFICER'S JURISDICTION WHEN THE OFFICER IS ON THAT PORTION OF <br />A ROADWAY ADJACENT TO THE OFFICER'S JURISDICTION AND WHEN <br />SAID ROADWAY BISECTS THE OFFICERS' JURISDICTION AND AN <br />ADJACENT GOVERNMENT'S BOUNDARY; PROVIDING FOR EFFECTIVE <br />DATE. <br /> <br />WHEREAS, a primary function of government is the safety and security of citizens traveling <br />on the roadways; and <br /> <br />WHEREAS, for several years the Council of Local Governments in Seminole County (known <br />as "CALNO"), has been concerned that the mutual aid statutes do not authorize a law enforcement <br />officer to enforce traffic laws outside that officer's jurisdictional limits, even where the governmental <br />boundary bisects a road, and the traffic violation occurs adjacent to the governmental boundary on <br />that road; and <br /> <br />WHEREAS, CALNO also recognizes the importance of a clear delineation of authority <br />between adjoining local governments, including in the area of traffic enforcement; and <br /> <br />WHEREAS, local governments are in the best position to delineate the authority for traffic <br />enforcement in areas where jurisdictional boundaries bisect a road, through entering into mutual aid <br />agreements; and <br /> <br />WHEREAS, in order to allow local governments to expand the scope of mutual aid <br />agreements to address this issue, CALNO believes the mutual aid statute should be amended to <br />provide that a law enforcement officer is authorized to act outside the officer's jurisdiction in the <br />very limited circwnstance described above, but only if it is the desire of the local governments in the <br />area. <br /> <br />. <br />NOW THEREFORE, to promote the security and safety of citizens throughout the state, and <br />to allow, at local option, the various law enforcement agencies and jurisdictions to enter into mutual <br />aid agreements to pernñt officers on certain specific roadways to enforce traffic laws for the safety of <br />all the citizens: <br /> <br />SECTION I. That Fla. Stat. §23.127(I) be amended as shown: <br /> <br />(1) Any employee of any Florida law enforcement agency who renders aid outside <br />the employee's jurisdiction but inside this state pursuant to the written agreement <br />entered under this part has the same powers, duties, rights, privileges, and inununities <br />
