charged; and <br /> <br /> WHEREAS, Chapter 166, Fla. Stat., authorizes the City to consider <br />stormwater and lake management as a City utility function for which service fees may <br />be charged; and <br /> <br /> WHEREAS, those elements of the City's system for the collection of and <br />disposal of storm and surface water and for the protection of surface and ground <br />waters are of benefit and provide services to all property located within the City <br />including property not presently served by the storm or lake management elements <br />of the system; and <br /> <br /> WHEREAS, the cost of operating and maintaining the City's stormwater and <br />lake management utility program and financing necessary repair, replacements, <br />improvements, and extension thereof should, to the extent practicable, be allocated <br />in relationship to the user impacts, benefits enjoyed, and services received <br />therefrom; and <br /> <br /> WHEREAS, it is necessary and desirable and in the best interest of the City <br />to establish a stormwater and lake management utility fee to fund the construction. <br />operation, maintenance, and administration of a public stormwater and lake <br />management program. <br /> <br /> NOW.
