CASSELBERRY CITY COMMISSION <br />Minutes of May 24, 2004 - Regular Meeting <br />Page 4 of 13 <br /> <br />Staff Presentation: Mr. Clifton stated Seminole County has formally objected to the notice it received <br />regarding Ordinance 04-1131 and the related urban services plan. Mr. Clifton recommended the City <br />Commission modify the agenda to hear the ordinance on first reading again and schedule the second reading <br />and public hearing for June 7, 2004 which would require calling a Special meeting. If approved, the <br />referendum could still occur on July 13, 2004. <br /> <br />MOTION: <br /> <br />Vice Mayor Clark moved to modify the Agenda and <br />change Public Hearing II to the First Reading of <br />Ordinance 04-1131. Motion was seconded by <br />Commissioner Doerner. Motion carried unanimously <br />by voice vote. <br /> <br />Mr. Wells stated in accordance with Section 171.0413, Florida Statues, Ordinance 04-1131 provides for a <br />referendum for annexation of Lake Howell Condominiums located on State Road 436 west of Lake Howell <br />and south of Red Bug Lake Road. The Lake Howell Condominium Association Board of Directors, <br />expressed a desire of annexing into the City. City staff prepared an urban services plan in support of the <br />annexation and provides basis for the referendum. The subject annexation area generally meets the statutory <br />criteria for annexation as established in Chapter 171, Florida Statutes. If adopted, a special referendum <br />election will be held among the registered voters of the lands to be annexed on July 13, 2004~ The election <br />will be held in the City Commission Chambers in City Hall from 7 a.m. to 7 p.m. Majority vote of the <br />eligible registered voters will determine whether or not the subject lands are annexed into the City. Staff <br />recommended approval of Ordinance 04-1131 on first reading. <br /> <br />Public Hearing: Mayor Pronovost asked if there was anyone in the audience that wished to speak either <br />for or against Ordinance 04-1131. The following individuals came forward: <br /> <br />1) John Casselberry, 700 South Lost Lake Lane, spoke in favor of Ordinance 04-113 l, <br />sta~ing it would enable the City to improve lake water management of Lake Howell. <br /> <br />2) Don Fisher, Seminole County Director of Planning & Development, 1101 East First <br />Street, Sanford, thanked the City Commission for their cooperation in reference to <br />Ordinance 04-1130 and requested the Commission delay action on Ordinance 04-1131 in <br />the same spirit of cooperation with Seminole County. <br /> <br />3) Karen Consalo, Seminole County Assistant County Attorney, (did not disclose address) <br />made a consistency objection on behalf of the County that the notice the County did receive <br />was not the urban services plan, but a fax listing the matter as a voluntary annexation which <br />led to some confusion. Ms. Consalo requested the City in the future the urban service <br />reports get filed with the Board of County Commissioners prior to commencement of the <br />advertising and to clarify whether the annexations are voluntary or involuntary. <br /> <br />No one else came forward.
