Motion was seconded by Commissioner <br />Doerner. Motion carried unanimously by voice vote. <br /> <br />PUBLIC HEARINGS <br /> <br />I. SECOND READING OF ORDINANCE 04-1119 - AMENDMENT TO THE CITY <br /> <br />CODE - CHAPTER 10 - OPEN CONTAINERS OF ALCOHOL <br /> <br />MOTION: <br /> <br />Vice Mayor Clark moved to read Ordinance 04-1119 <br />by title only. Motion was seconded by Commissioner <br />Hart. Motion carried unanimously by voice vote. <br /> <br />The City Clerk read Ordinance 04-1119 by title as follows: <br /> <br />"AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, RELATING TO <br />OPEN OR UNSEALED ALCOHOLIC BEVERAGES; ESTABLISHING SECTION 10-9, <br />"THE CAS SELBERRY OPEN OR UNSEALED ALCOHOLIC BEVERAGE CODE"; OF <br />CHAPTER 10 OF THE CITY CODE OF ORDINANCES; PROVDING FOR <br />DEFINITIONS; PROVIDING FOR POSSESSION OR CONSUMPTION PROHIBITED; <br />INAPPLICABILITY/EXCEPTIONS; AND ENFORCEMENT; AND PENALTY; <br />PROVIDING FOR SEVERABILITY, CODIFICATION, CONFLICTS AND EFFECTIVE <br />DATE.' <br /> <br />Legal Advertisement: The Notice of Public Heating relative to Ordinance 04-1119 was published in the <br />Orlando Sentinel on March 11, 2004. <br /> <br />Staff Presentation: Ordinance 04-1119 provides for prohibition of alcoholic beverage open containers or <br />unsealed alcoholic beverage in public or semi-public parking lots and public or semi-public highways. Mrs. <br />Reischmann suggested the following amendment to Section E - Penalty: <br /> <br />"Any person convicted of a violation of this ordinance where no specific penalty is provided by state law <br />shall, upon conviction, be punished as provided in Section 1-13(a) of the City of Casselberry Code of <br />Ordinances. Section 10-9(B)(1) shall be punishable as a civil infraction as provided in Fla. Stat. s. <br />316.1936. <br /> <br />Staff recommended approval of Ordinance 04-1119 on second reading. <br /> <br /> <br />
