WHEREAS, words with underlined type shall constitute additions to the original text, strike <br />through type shall constitute deletions to the original text, and asterisks (* * *) shall indicate that text <br />remains unchanged from the language existing prior to adoption of this Ordinance. <br />NOW, THEREFORE, BE IT ENACTED BY THE CITY COMMISSION OF THE <br />CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: <br />SECTION I. RECITALS. The above recitals are hereby adopted as the legislative findings <br />of the City Commission. The City Commission finds and determines that there is competent <br />substantial evidence to support the findings and determinations made in this Section. <br />SECTION II. Part III, Unified Land Development Regulations, Chapter II, District and <br />General Regulations, Article VII, General Regulations, of the Code of Ordinances of the City is <br />hereby amended by adding a new section to be numbered Section 2-7.37, which section shall read, as <br />follows: <br />Section 2-7.37. — Hotels, motels, and transient lodging. <br />A. Purpose and intent. The regulations and reauirements set forth herein are adopted for the <br />following purposes: <br />1. To create land use regulations within the City's Unified Land Development <br />Regulations for hotel, motel, and transient lodging facilities consistent with Section <br />2-5.3, Table 2-5.3, Land Use by District, and Table 2-5.4, Size and Dimension <br />Regulations. <br />2. To ensure that lodgingdevelopment, operation, and maintenance of hotels, motels, <br />and transient lodging considered as quality by the City is encouraged through a <br />defined planning_ design, and engineering process. <br />3. To define the types of hotel, motel, and lodging facilities essential for a changing and <br />upgraded hospitality industr. <br />4. To promote public health, safety, general welfare, and aesthetics of the City through <br />siting within applicable zoning of hotel, motel, and lodging facilities, while <br />attempting to minimize potential public and private nuisances. <br />B. Applicability. This Section shall apply to all lodging facilities within the City. <br />C. Standards. The following elements shall be reviewed for hotels, motels, and transient lodging <br />facilities: <br />1. Hotel, motel, and transient lodging facilities, as defined in Section 5-21.2 of the <br />City's Unified Land Development Regulations, is a commercial land use. <br />2. The hotel or motel shall have one (1) hotel manager and one (1) employee on <br />premises at all times to respond toue�sts, public safety personnel, and the public. <br />3.
