ORDINANCE 19-1527 <br />AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, <br />AMENDING THE CITY UNIFIED LAND DEVELOPMENT REGULATIONS, <br />CHAPTER II, DISTRICT AND GENERAL REGULATIONS, ARTICLE VII, <br />GENERAL REGULATIONS, ADDING SECTION 2-7.37, HOTELS, <br />MOTELS, AND TRANSIENT LODGING, TO ADD LODGING STANDARDS, <br />AND AMENDING CHAPTER V, GLOSSARY, ARTICLE XXI, LANGUAGE <br />AND DEFINITIONS, SECTION 5-21.2, DEFINITION OF TERMS, ADDING <br />AND AMENDING DEFINITIONS FOR LODGING TYPES; PROVIDING <br />FOR CODIFICATION, CONFLICTS, SEVERABILITY, AND AN <br />EFFECTIVE DATE. <br />WHEREAS, the City of Casselberry, Florida, (City) desires to encourage and to <br />accommodate well-built and well-maintained quality lodging in the form of hotels, motels, and <br />transient lodging types; and <br />WHEREAS, to address lodging land use types and standards within the hospitality industry <br />pertaining to existing definitions in the City's Code of Ordinances, the City is creating Section 2- <br />7.37 of the Unified Land Development Regulations (ULDR) for hotels, motels, and transient <br />lodging; and <br />WHEREAS, the City's defined lodging types within Section 5-21.2 of the ULDR shall be <br />amended through this Ordinance for existing and proposed hospitality lodging types and new <br />definitions will be included in Section 5-21.2 of the ULDR; and <br />WHEREAS, the proposed creation of Section 2-7.37 and amendments to Section 5-21.2 of <br />the ULDR shall provide proper land use, zoning, transportation, and utility provisions for the <br />redevelopment of existing facilities and construction of new lodging types; and <br />WHEREAS, Section 2-7.37 of the ULDR will provide land use standards for hospitality <br />lodging, upon adoption of this Ordinance; and <br />WHEREAS, the amendments to Section 5-21.2 of the ULDR include an updated definition <br />for hotels, motels, and transient lodging facilities and associated terms; and <br />WHEREAS, research indicates that certain extended stay lodging types result in higher <br />public safety responses that causes increased resource allocation of public safety personnel and <br />public fund expenditures responding to incidents, and responses are needed to ensure adequate <br />protection of lodging occupants, City residents, and the public; and <br />WHEREAS, the Casselberry City Commission finds that the proposed amendments will lead <br />to the appropriate location of lodging facilities within applicable zoning districts, protects the public <br />health, safety, and welfare, and serve as a legitimate governmental interest in preserving quality -of - <br />life within the City of Casselberry; and <br />
