Regulations (ULDR) are not consistent throughout the zoning districts for properties zoned for <br />multi -family; and <br />WHEREAS, considering the setbacks, density, stormwater and parking requirements <br />necessary to build multifamily developments, the impervious surface ratio (ISR) needs to be <br />adjusted; and <br />WHEREAS, when reviewing the Size and Dimension Criteria within Section 2-5.4, <br />Table 2-5.4, many errors were noted from previous ordinances that required attention. <br />Additionally, many zoning districts were improperly named; and <br />WHEREAS, the City's Planning and Zoning Commission sitting as the Land Planning <br />Agency has reviewed this Ordinance and finds it is consistent with the comprehensive plan; and <br />WHEREAS, words with double underlined type shall constitute additions to the original <br />text and strike through shall constitute deletions to the original text, and asterisks (* * *) indicate <br />that text shall remain unchanged from the language existing prior to adoption of this Ordinance. <br />NOW THEREFORE, BE IT ENACTED BY THE CITY COMMISSION OF THE <br />CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: <br />SECTION 1. Part III — Unified Land Development Regulations, Chapter II — District <br />and General Regulations, Article V — Zoning District Regulations, Section 2-5.4, Table 2-5.4 <br />Size and Dimension Regulations, of the Code of Ordinances of the City of Casselberry, Florida, <br />Table 2-5.4 is repealed and replaced in its entirety, and amending the footnotes (C) and (S) as <br />shown in Exhibit "A" attached and incorporated herein. <br />SECTION 2. Part III — Unified Land Development Regulations, Chapter II — District <br />and General Regulations, Article XV — Offstreet Parking and Loading Requirements, Section 3- <br />15.2, Parking spaces required by use, of the Code of Ordinances of the City of Casselberry, <br />Florida, is amended as shown in Exhibit "B" attached and incorporated herein. <br />SECTION 3. Part III — Unified Land Development Regulations, Chapter III — <br />Performance Criteria, Article X, Appearance, Design and Compatibility, Section 3-10.12, Design <br />criteria for buildings in excess of 35 feet in height, of the Code of Ordinances of the City of <br />Casselberry, Florida, is amended as follows: <br />In all areas designated as Commercial, Industrial, High Density Residential, Medium Density <br />Residential or Low Intensity Nonresidential/Medium Density Residential on the City of <br />Casselberry Comprehensive Plan Future Land Use Map and zoned CG, CS, IND, RMF -13. <br />RMF -20. PRD or PMX-L, building heights in excess of 35 feet may be permitted as a <br />conditional use pursuant to the criteria established in Article VI of this Code.
