ORDINANCE 19-1505 <br />AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, <br />AMENDING THE CITY CODE OF ORDINANCES, PART III, UNIFIED <br />LAND DEVELOPMENT REGULATIONS TABLE 2-5.4, SIZE AND <br />DIMENSION REGULATIONS, TO REPEAL AND REPLACE TABLE 2- <br />5.4 TO CORRECT SCRIVENER'S ERRORS, AND TO REDUCE <br />CERTAIN ZONING CATEGORIES' MINIMUM LIVING AREA AND <br />IMPERVIOUS SURFACE RATIOS; TO AMEND SECTION 3-15.2, <br />PARKING SPACES REQUIRED BY USE, TO DECREASE THE <br />PARKING RATIO FOR MULTI -FAMILY RESIDENTIAL; AMENDING <br />SECTION 3-10.12 TO ADD RMF -13, RMF -20 AND PRD TO THE LIST OF <br />ZONING DISTRICTS ABLE TO REQUEST A CONDITIONAL USE <br />APPROVAL FOR BUILDINGS IN EXCESS OF 35 FEET; PROVIDING <br />FOR CODIFICATION, CONFLICTS, SEVERABILITY, AND <br />EFFECTIVE DATE. <br />WHEREAS, the City of Casselberry continuously monitors and reviews the Code of <br />Ordinances and the Unified Land Development Regulations to ensure appropriate regulations for <br />development and zoning within the City, and from time to time recognizes the need to study and <br />amend aspects of same; and <br />WHEREAS, in 2013, the Urban Land Institute produced research titled "The Macro <br />View on Micro Units " on market trends in urban settings indicating an increased demand in <br />smaller multifamily unit sizes and increases in the number of studio and one bedroom multi- <br />family units; and <br />WHEREAS, these trends show that occupancy rates of these smaller residential units are <br />greater than those units with a larger square footage footprint; and <br />WHEREAS, the City Commission adopted Ordinance 14-1414 which provided smaller <br />living unit sizes and a smaller parking ratio for the Lake Concord Overlay District in keeping <br />with the research developed for market trends in urban settings; and <br />WHEREAS, the City of Casselberry adopted Ordinance 16-1446 on July 11, 2016 to <br />decrease the minimum living area and decrease the parking spaces required by use, to align with <br />the reduced minimum living areas specifically within the Major Thoroughfare Mixed Use <br />(MTMU) Future Land Use designation, in light of those market changes; and <br />WHEREAS, a jurisdictional analysis of the surrounding municipalities shows <br />provisions for smaller living units, smaller parking ratios and taller buildings for multi -family <br />housing specifically in more urban settings, but the City's Unified Land Development <br />Ordinance 19-1505 <br />Page 5 of 9 <br />
