RESOLUTION 25-3489 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, APPROVING AND AUTHORIZING EXECUTION OF A RELEASE, HOLD HARMLESS AND INDEMNIFICATION AGREEMENT FOR THE SEMINOLA PLAZA LOCATED AT 1523 SEMINOLA BOULEVARD, CASSELBERRY, FLORIDA; PROVIDING FOR CONFLICTS, SEVERABILITY, AND AN EFFECTIVE DATE. WHEREAS, on June 19, 2024, Seminola Plaza located at 1523 Seminola Blvd. (Property) received Site Plan approval (SPR 24-02) from the City of Casselberry's (City) Planning and Zoning Commission, with one of the conditions of Engineering Permit approval prior to construction; and WHEREAS, on September 19, 2024, an Engineering Permit review application was submitted to the City for site development at the Property; and WHEREAS, the required review and inspection fee for the Engineering Permit was submitted on December 4, 2024; and WHEREAS, between September and December 2024, a significant portion of construction for utility and drainage connections and other site developments occurred at the Property without the Engineering Permit and a stop -work order was issued; and WHEREAS, on January 29, 2025, the Engineer of Record (EOR) for Seminola Plaza certified that all installations completed to date at the Property met all City and Seminole County specifications; and WHEREAS, in the interest of its citizens and businesses, the City seeks to assist applicants in development within the City; and WHEREAS, the Release, Hold Harmless and Indemnification Agreement (Agreement) authorizes and allows the permit Owner to continue the construction of the site development upon obtaining the Engineering Permit; and WHEREAS, the City Commission has determined it to be in the best interest of City residents and the community overall to execute the aforementioned Agreement to allow Seminola Plaza to continue construction of the Project. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA: SECTION I. The City Commission of the City of Casselberry hereby approves the Release, Hold Harmless and Indemnification Agreement, attached herewith, with the Developer and Owner for the property located at 1523 Seminola Blvd, and authorizes the City Manager to execute said document on behalf of the City Commission.
