CITY OF CASSELBERRY <br />BOARD OF ADJUSTMENT <br />The City of Casselberry Board of Adjustment held a public hearing on Thursday, October 28, 2010, at 6,30 P.M., <br />in the Casselberry City Hall Commission Chambers, 95 Triplet Lake Drive, Casselberry, Florida. <br />Members present were: <br />Luis Guzman, Vice Chairman <br />Earl McMullen <br />Phyllis Wallace, Alternate <br />Members absent were; <br />Mary Anne Gauvin, Chairman <br />Brian Suto <br />Staff members present: <br />Eric Raasch, Planner I <br />Joni Dixon, Sr. Staff Assistant <br />First Item of Business: Approval of Minutes for the public hearing held on Thursday, September 23, 2010. <br />Mr. Guzman stated the Chair would entertain a motion on the approval of the minutes forthe public hearing held <br />on Thursday, September 23, 2010. Mr. McMullen moved to accept the September 23, 2010 minutes. Mr. Wallace <br />seconded the motion. The motion passed unanimously by voice vote. <br />Second Item of Business: Disclosure of Ex Parte communications. <br />No disclosure of Ex Parte Communications was made by the Board. <br />Third Item of Business: BA 10-07: 477 Misty Oaks Run. Variance request to Article V, Section 2.5.4 "Size and <br />®imension Criteria" and Table 2.5.4 of the Casselberry Unified Land Development Regulations to allow a 12.0 <br />foot rear building setback in lieu of the 20.0 foot building setback required within the Lake Griffin Estates PRD <br />zoning district. <br />Mr. Guzman asked the applicant to come forward. Mr. Richard Pratt and Mrs. Sunny Pratt, 477 Misty Oaks Run, <br />Casselberry, Florida came forward. Mrs. Pratt said she would like her contractor to make his presentation at this time. <br />Mr. Doug Hamilton, 29940 Rainey Road, Sorrento, Florida came forward. Mr. Hamilton distributed and reviewed the <br />proposed design of the enclosure and also a layout of the neighbor's home showing the pool and screen enclosure (a <br />copy is attached and made a part of the minutes). Mr. Hamilton said the applicant would like to add a screen room with a <br />roof to provide protection from the rain. He said construction of a pool would cause more impervious area and the <br />community has very strict rules regarding impervious surface. He said the applicant would like to encroach 7.2 feet into <br />
