RESOLUTION 05 - 1627 "A RESOLUTION OF THE CITY OF CASSELBERRY, FLORIDA, AUTHORIZING CLOSING, VACATING AND ABANDONING A PORTION OF THE BELLE AVENUE RIGHT-OF-WAY AS PLATTED IN JOHNSON'S POULTRY FARMS, AS RECORDED IN PLAT BOOK 6, PAGE 8 OF THE PUBLIC RECORDS OF SEMINOLE COUNTY, FLORIDA; PROVIDING FOR CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE." WHEREAS, a petition was liled with the City Commission 01 the City 01 Casselberry, Florida, to close, vacate and abandon a portion 01 the Belle Avenue Right-Ol-Way, more particularly described on Exhibit "A"; and WHEREAS, all affected utilities have reviewed the petition; and WHEREAS, the City Commission linds that the closing, vacating and abandoning a portion 01 said right-ol-way will not present a detriment to either the City 01 Casselberry, Florida, or the public. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: Section I. The City Commission 01 the City 01 Casselberry hereby approves the closing, vacating and abandonment 01 a portion 01 the Belle Avenue Right-ol-Way as described on Exhibit "A" in the City 01 Casselberry as 01 this date and the City Commission 01 the City 01 Casselberry, Florida, renounces any rights in and to the alore-described right-ol-way, attached as "Exhibit A", and authorizes the Mayor to sign the resolution. Section II. Conllicts. All Resolutions or parts 01 Resolutions in conflict with any 01 the provisions 01 this Resolution are hereby repealed. Section III. Severabilitv. II any Section or portion 01 a Section 01 this Resolution proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, lorce, or effect 01 any other Section or part 01 this Resolution.
