RESOLUTION 14-2673 <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF <br />CASSELBERRY, FLORIDA, APPROVING SUPPLEMENTAL <br />AGREEMENT NO. 1 TO THE STATE HIGHWAY MAINTENANCE <br />MEMORANDUM OF AGREEMENT (MOA) BETWEEN THE FLORIDA <br />DEPARTMENT OF TRANSPORTATION (FDOT) AND THE CITY OF <br />CASSELBERRY; PROVIDING FOR CONFLICTS, SEVERABILITY, AND <br />EFFECTIVE DATE. <br />WHEREAS, for nearly 15 years, the City has received compensation from the Florida <br />Department of Transportation (FDOT) for maintaining the beautification and routine right-of-way <br />maintenance elements of U.S. Highway 17-92 and S.R. 436; and <br />WHEREAS, on November 13, 2012 via Resolution 12-2432, the City Commission <br />approved the renewal of State Highway Maintenance Memorandum of Agreement (MOA) with <br />FDOT (Contract# APT00) that provided compensation to the City for continuing to maintain the <br />right-of-ways on the aforesaid roadways; and <br />WHEREAS, FDOT has submitted Supplemental Agreement No. 1 to the current MOA that <br />will provide an additional $20,844 of compensation to the City for area maintenance of right-of- <br />ways on S.R. 436 from Howell Branch Road to the southern end of the City limits for an adjusted <br />total amount of $90,844.00 until April 30, 2016; and <br />WHEREAS, Public Works staff has reviewed the proposed Supplemental Agreement No. <br />1 to the State Highway Maintenance MOA with FDOT and finds it favorable to the City. <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br />CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: <br />SECTION I. The City Commission of the City of Casselberry hereby approves <br />Supplemental Agreement No. 1 to the State Highway Maintenance Memorandum of Agreement <br />between the Florida Department of Transportation and the City of Casselberry, District Contract <br />Job Number APT00-R1, State Job Number 244549-1-78-01, for an additional compensation <br />amount of $20,844, and authorizes the Mayor to execute said document on behalf of the City. <br />SECTION II. The City Commission hereby accepts the terms and conditions as presented <br />in said Agreement. <br />SECTION III. Conflicts. All Resolutions or parts of Resolutions in conflict with any of <br />the provisions of this Resolution are hereby repealed. <br />SECTION IV. Severability. If any Section or portion of a Section of this Resolution <br />proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the <br />validity, force, or effect of any other Section or part of this Resolution. <br />
