RESOLUTION 1.2-2445 "A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, AUTHORIZING THE EXECUTION OF AN AGREEMENT WITH THE FLORIDA DEPARTMENT OF TRANSPORTATION FOR DECORATIVE MAST ARM TRAFFIC SIGNALIZATION IMPROVEMENTS RELATED TO THE US HIGHWAY 17-92 AND STATE ROAD 436 INTERCHANGE PROJECT; PROVIDING FOR CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE." WHEREAS, as a result of recent funding changes, the Florida Department of Transportation (FDO'T) has announced that the U.S. Highway 17-92 and SR 436 Interchange Project has been accelerated and budgeted for construction in FDOT's fiscal year 2014, which commences July 1, 2013; and WHEREAS, this project is a multi -agency transportation improvement project that is designed to ease traffic congestion at the busy intersection of U.S. Highway 17-92 and SR 436 in Casselberry; and WHEREAS, City staff wishes to upgrade FDOT's proposed standard traffic signalization plans for the intersections of SR 436 / Plaza Entrance and SR 436 /Oxford Road; and WHEREAS, this upgrade includes the installation of decorative "black" mast arm traffic signalization improvements with acorn light fixtures at these respective intersections as they reflect the City's vision and maintains aesthetic continuity along this major corridor; and WHEREAS, FDOT has submitted an agreement for an amount not to exceed $115,000.00 without prior written authorization to implement said upgrades; and WHEREAS, City staff has reviewed the agreement submitted by FDOT for decorative mast arm traffic signalization improvements related to the U.S. Highway 17-92 and SR 436 Interchange Project and finds it favorable to meet the needs of the City. NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: SECTION I. The City Commission of the City of Casselberry hereby approves the agreement submitted by the Florida Department of Transportation for mast arm signalization improvements related to the U.S. Highway 17-92 and SR 436 Interchange Project, in the amount not to exceed $115,000.00 without prior authorization, and authorizes the Mayor to execute said document on behalf of the City. SECTION II. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the provisions of this Resolution are hereby repealed. SECTION HI. Severability. If any Section or portion of a Section of this Resolution proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, or effect of any other Section or part of this Resolution. SECTION IV. Effective Date. This Resolution shall become effective immediately upon its passage and adoption.
