RESOLUTION 23-3382 <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF <br />CASSELBERRY, FLORIDA, APPROVING AND AUTHORIZING THE <br />EXECUTION OF AN AGREEMENT WITH THE FLORIDA <br />DEPARTMENT OF ENVIRONMENTAL PROTECTION FOR A LAND <br />AND WATER CONSERVATION FUND GRANT FOR THE DEW DROP <br />PARK IMPROVEMENTS PROJECT; PROVIDING FOR CONFLICTS, <br />SEVERABILITY, AND EFFECTIVE DATE. <br />WHEREAS, the City of Casselberry, through its Parks, Recreation, Pathways, and Open <br />Spaces Master Plan, has identified the need for improvements to Dew Drop Park; and <br />WHEREAS, the City of Casselberry, in January 2023, applied to the Florida Department of <br />Environmental Protection (FDEP) for $1,500,000 in Land and Water Conservation Fund Grant <br />funding with a $1,500,000 local match commitment, for a total of $3,000,000 to construct the Dew <br />Drop Park Improvements Project; and <br />WHEREAS, FDEP ranked the City of Casselberry's application #2 in the State of Florida <br />in the Development Category, and the National Park Service subsequently awarded the requested <br />grant funding for the City's project; and <br />WHEREAS, FDEP has provided the City of Casselberry a proposed Agreement to execute <br />the project under the terms of the grant; and <br />WHEREAS, City staff has reviewed the aforementioned Agreement and finds it acceptable <br />to meet the needs of the City. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br />CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: <br />SECTION I. The City Commission of the City of Casselberry hereby approves the <br />Agreement with the Florida Department of Environmental Protection for the Dew Drop Park <br />Improvements Project (including a commitment of $1,500,000 in local funding and $1,500,000 in <br />federal grant funding, for a total commitment of $3,000,000) and authorizes the Mayor to execute <br />said document on behalf of the City. <br />SECTION II. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the <br />provisions of this Resolution are hereby repealed. <br />SECTION III. Severability. If any Section or portion of a Section of this Resolution <br />proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the <br />validity, force, or effect of any other Section or part of this Resolution. <br />SECTION IV. Effective Date. This Resolution shall become effective immediately upon <br />its passage and adoption. <br />PASSED and ADOPTED this �) o O day of j : 1')(! C 5 AD 2023. <br />
