RESOLUTION 23-3387 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, APPROVING AND AUTHORIZING THE EXECUTION OF SUPPLEMENTAL AGREEMENT NO. 1 TO THE LOCAL AGENCY PROGRAM AGREEMENT WITH THE STATE OF FLORIDA DEPARTMENT OF TRANSPORTATION FOR THE CONSTRUCTION OF THE SOUTHCOT DRIVE BICYCLE / PEDESTRIAN IMPROVEMENTS PROJECT; PROVIDING FOR CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE. WHEREAS, via Resolution 23-3556, the City Commission of the City of Casselberry approved a Local Agency Program (LAP) agreement with the Florida Department of Transportation (FDOT) to provide federal funding to construct the Southcot Drive Bicycle/Pedestrian Improvements Project; and WHEREAS, for FDOT purposes, the project is also referred to as the "Southcot Drive Sidewalk from Sunset Drive to Lake Triplett Drive" project and the "Southcot Drive Sidewalk" project; and WHEREAS, funding provided via the original LAP agreement did not fully cover all eligible costs for the project; and WHEREAS, subsequently, MetroPlan Orlando programmed additional funding in the amount of $148,226.13 to offset the shortfall of federally eligible costs; and WHEREAS, these additional funds provided by MetroPlan Orlando significantly reduces the required local contributions; and WHEREAS, Supplemental Agreement No. 1, submitted by FDOT, provides for the update to the original LAP agreement which acknowledges the additional funding provided by MetroPlan Orlando; and WHEREAS, City staff has reviewed the aforementioned Agreement and finds it acceptable to meet the needs of the City. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: SECTION I. The City Commission of the City of Casselberry hereby approves Supplemental Agreement No. 1 to the Local Agency Program Agreement with the State of Florida Department of Transportation for the construction of the Southcot Drive Bicycle / Pedestrian Improvements Project and authorizes the Mayor to execute said document, attached herewith, on behalf of the City. SECTION II. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the provisions of this Resolution are hereby repealed.
