RESOLUTION 24-3477 <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF <br />CASSELBERRY, FLORIDA, APPROVING AND AUTHORIZING THE <br />EXECUTION OF A SECOND AMENDMENT TO THE FIRE AND <br />EMERGENCY MEDICAL SERVICES INTERLOCAL AGREEMENT <br />BETWEEN SEMINOLE COUNTY AND THE CITY OF CASSELBERRY <br />WHICH INCLUDES THE CONVEYANCE OF REAL PROPERTY TO <br />SEMINOLE COUNTY AND A PURCHASE AND SALE AGREEMENT; <br />PROVIDING FOR CONFLICTS, SEVERABILITY, AND AN EFFECTIVE <br />DATE. <br />WHEREAS, CITY and COUNTY entered into an Interlocal on December 22, 2014, to <br />provide fire, rescue, and emergency medical services to CITY (the "Interlocal"); and <br />WHEREAS, CITY and COUNTY entered into a First Amendment to the Interlocal on <br />February 14, 2017; and <br />WHEREAS, the parties desire to further amend the Interlocal in a Second Amendment to <br />implement Section 6(b)(1)(iii) of the Interlocal concerning the Wilshire Property and Fire Station 25, <br />as described in the Interlocal, and to enable both parties to continue to enjoy the mutual benefits the <br />Interlocal provides; and <br />WHEREAS, Section 6(b)(1)(iii) of the 2014 Interlocal provides that CITY and COUNTY <br />agree that approximately two acres of the Wilshire Property, as described in Attachment D of the <br />2014 Interlocal and currently owned by CITY, will be developed exclusively for a COUNTY <br />EMS/Fire/Rescue station; and <br />WHEREAS, CITY and COUNTY intend to provide each other with access easements over <br />their respective entry ways, parking, and driveways, and the County will grant the City two utility <br />easements, l) over the access entry way from SR 436, and 2) over a portion of the Fire Station property <br />adjacent to Wilshire Blvd.; and <br />WHEREAS, CITY and COUNTY intend to enter into a Second Amendment to the 2014 <br />Interlocal and the Purchase Agreement to implement the plans for the two stations. <br />NOW THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF <br />CASSELBERRY, FLORIDA, AS FOLLOWS: <br />SECTION 1. The City Commission hereby approves and authorizes the Mayor to sign the <br />Second Amendment attached as Exhibit A, and the Purchase Agreement attached as Exhibit B. <br />SECTION 2. The City Conunission hereby approves the proposed Cross Access, Parking, <br />Utility and Dumpster Easement and Maintenance Agreement attached to the Second Amendment and <br />
