RESOLUTION 08-1964 <br />"A RESOLUTION OF THE CITY OF CASSELBERRY, FLORIDA, AUTHORIZING THE <br />EXECUTION OF AN AGREEMENT WITH EROSION STOPPERS, INC. FOR THE GEE <br />CREEK EROSION CONTROL PROJECT AT GEE CREEK LANE; PROVIDING FOR <br />CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE." <br />WHEREAS, the City of Casselberry has identified five (5) project areas in need of structural and non- <br />structural erosion control measures, one of which includes the Gee Creek at Gee Creek Lane Project; and <br />WHEREAS, these erosion control measures within Gee Creek will alleviate the pervasive erosion <br />experienced within the project area; and <br />WHEREAS, the City of Casselberry recently awarded a competitively bid contract to Erosion Stoppers, Inc. <br />for a similar, NRCS funded project within Gee Creek paralleling Osceola Trail and Gee Creek Lane; and <br />WHEREAS, Erosion Stoppers, Inc. has submitted a proposal in the amount of $141,846.97, based on unit <br />prices awarded in the original Gee Creek erosion control project, to construct additional erosion protection measures <br />along Gee Creek parallel to Gee Creek Lane; and <br />WHEREAS, City staff has reviewed proposal from Erosion Stoppers, Inc., in the amount of $141,846.97, and <br />found it to be the sufficient to meet the project requirements of the City; and <br />WHEREAS, funding for the majority of the project will be funded by the Natural Resources Conservation <br />Service. <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF <br />CASSELBERRY, FLORIDA, AS FOLLOWS: <br />SECTION I. The City Commission of the City of Casselberry hereby approves the Agreement with Erosion <br />Stoppers, Inc., attached as Exhibit "A", and authorizes the Mayor to execute said document on behalf of the City. <br />SECTION H. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the provisions of this <br />Resolution are hereby repealed. <br />SECTION III. Severability. If any Section or portion of a Section of this Resolution proves to be invalid, <br />unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, or effect of any other <br />Section or part of this Resolution. <br />SECTION IV. Effective Date. This Resolution shall become effective immediately upon its passage and <br />adoption. <br />PASSED and ADOPTED this �& <br />A' , T�ST: <br />onna G.
