"Exhibit A" PROJECT NO. 0403 4. CONTRACT TIME AND LIQUIDATED DAMAGES Work under this Agreement shall be commenced within thirty (30) days after issuance of written Notice to Proceed, and shall be completed within ninety (90) calendar days to Substantial Completion from the issuance of the written Notice to Proceed plus thirty (30) days to Final Completion. Contractor shall pay the Owners as liquidated damages the amount of ONE THOUSAND DOLLARS & NO/100 ($1,000) for each calendar day that expires after the Contract Time specified above including any adjustments thereof approved by proper Change Order until the Work is finally complete. This amount represents an estimate of Owner's damages for loss of use and administrative costs associated with delay. 5. AUTHORITY AND RESPONSIBILITY OF THE OWNER All Work shall be done under the general supervision of the Owner. The Owner shall decide any and all questions which may arise as to the quality and acceptability of materials furnished, work performed, rate of progress of work, interpretation of Specifications, and all questions as to the acceptable fulfillment of the Agreement on the part of the Contractor. These provisions shall not release the Contractor from any Contractor responsibility contained herein. 6. CONTRACT DOCUMENTS The Agreement comprises the Contract Document listed herein. In the event that any provision of one Contract Document conflicts with the previsions of another Contract Document, the provision in that Contract Document first listed below shall govern, except as otherwise specifically stated: Agreement (this instrument); Change Orders Addenda to Contract Documents, Nos.
