SECOND READING OF ORDINANCE 04-1118 - MODIFICATION TO SECTION <br /> <br /> 36 OF THE CITY CHARTER - QUALIFYING PERIOD FOR CITY ELECTIONS <br /> <br />MOTION: Vice Mayor Clark moved to read Ordinance 04-1118 <br /> by title only. Motion was seconded by Commissioner <br /> Cook. Motion carried unanimously by voice vote. <br /> <br />The City Clerk read Ordinance 04-1118 by title as follows: <br /> <br />"AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, AMENDING <br />SECTION 36, PROCEDURE FOR PLACING NAMES ON BALLOT; ALTERNATIVE <br />METHOD OF QUALIFYING OF ARTICLE VI1, ELECTIONS, OF THE CITY <br />CHARTER; AUTHORIZING THE CITY COMMISSION TO DESIGNATE A <br />QUALWYING PERIOD FOR CITY ELECTIONS AS PROVIDED FOR IN SECTION <br />100.3605, FLORIDA STATUTES; PROVIDING FOR SEVERABILITY, CODI]7ICATION, <br />CONFLICTS AND EFFECTIVE DATE." <br /> <br />Legal Advertisement: The Notice of Public Hearing relative to Ordinance 04-1118 was published in the <br />Orlando Sentinel on January 29, 2004. <br /> <br />Staff Presentation: Mrs. Reischmann stated Ordinance 04-1118 provides for changing the qualifyingperiod <br />for City Elections, in order to coincide with time requirements pertaining to submission of required candidate <br />documentation to the Supervisor of Elections Office. A referendum is not required for this Charter change, <br />pursuant to 100.3605, Florida Statutes. The City Commission passed Ordinance 04-1118 on first reading <br />on January 12, 2004. Pursuant to discussion at the January 12, 2004 meeting, Section 36(3) was revised to <br />clarify that each petition must be filed with the City Clerk on or before the first business day in August. The <br />Supervisor of Elections indicated to the City Clerk that this clarification would allow for sufficient time to <br />verify the petition signatures. Staff recommended approval of Ordinance 04-1118. <br /> <br />Public Hearing: Mayor Pronovost asked if there was anyone in the audience that wished to speak either <br />for or against Ordinance 04-1118. No one came forward. Mayor Pronovost closed the public hearing. <br /> <br /> <br />
