RESOLUTION04-1485 <br /> <br />"A RESOLUTION OF THE CiTY OF CASSELBERRY, FLORIDA, TO ENTER INTO A LEASE <br />AGREEMENT WITH PROGRESS ENERGY, FLORIDA FOR CONTRIBUTION IN AID OF <br />CONSTRUCTION OF DECORATIVE STREET LIGHTING FOR THE CDBG LAKE KATHRYN <br />PARK NEIGHBORHOOD IMPROVEMENTS PROJECT; PROVIDING FOR CONFLICTS, <br />SEVERABILITY, AND EFFECTIVE DATE." <br /> <br />WHEREAS, it is in the best interest of the City of Casselberry to pursue the lease of decorative <br />street lighting for the CDBG Lake Kathryn Park Neighborhood Improvements Project, specifically <br />on Bluebell, Camellia & Wingo Drives; and <br /> <br />WHEREAS, the City of Casselberry desires to provide enhanced and upgraded lighting fixtures <br />within the City; and <br /> <br />WHEREAS, the City of Casselberry has the ability to enter into a lease agreement for the <br />installation of decorative street lighting; and <br /> <br />WHEREAS, Progress Energy, Florida has previously demonstrated the ability to perform the <br />requisite services in a satisfactory manner. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF <br />CASSELBERRY, FLORIDA, AS FOLLOWS: <br /> <br />SECTION I. The City Commission of the City of Casselberry hereby approves the Contribution in <br />aid of Construction Agreement and Lighting Service Application with Progress Energy, Florida <br />(attached as "Exhibit A & B'), and authorizes the Mayor to execute said documents on behalf of <br />the City. <br /> <br />SECTION II. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the <br />provisions of this Resolution are hereby repealed. <br /> <br />SECTION III. Severability. If any Section or portion of a Section of this Resolution proves to be <br />invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, or <br />effect of any other Section or part of this Resolution. <br /> <br />SECTION IV. Effective Date.
