Wells, AICP, <br />Community Development Director <br />95 Triplet Lake Drive <br />Casselberry, FL 32707 <br /> <br /> ORDINANCE # 04-1123 <br /> <br /> AN ORDINANCE OF THE CITY OF CASSELBERRY,~ FLORIDA, TO AMEND THE <br /> CITY OF CASSELBERRY COMPREHENSIVE PLAN, BY AMENDING THE <br /> OFFICIAL FUTURE LAND USE MAP ESTABLISHING THE FUTURE LAND USE <br /> DESIGNATION OF MEDIUM DENSITY RESIDENTIAL (MDR) FOR THOSE <br /> PARCELS DESCRIBED IN SECTION I OF THIS ORDINANCE; PROVIDING FOR <br /> CONFLICTS, SEVERABILITY, AND AN EFFECTIVE DATE. <br /> Whereas, a Public Hearing on the question of amending the Low Intensity Non-residential/Medium <br />Density Residential future land use designation of the property hereinafter described, has been duly held in <br />the City of Casselberry, Florida and at such hearing, interested parties and citizens for and/or against the <br />proposed establishment of the City of Casselberry Medium Density Residential future land use designation <br />were heard; and <br /> Whereas, the Casselberry Planning and Zoning Commission/Land Planning Agency has held a public <br />hearing with due public notice to consider the comprehensive plan amendment; and <br /> <br /> Whereas, after said Public Hearing, the City Commission of the City of Casselbemj, Florida, has held <br />a public hearing to consider the comprehensive plan amendment and has determined that the Future Land <br />Use designation of said properties shall be established as Medium Density Residential as that designation <br />is defined in Future Land Use Element Policies FLU 1.2, as amended and supplemented, of the <br />Comprehensive Plan of the City of Casselberry, Florida; and <br /> <br /> Whereas, such amendments are permitted subject to the provisions of F.S. Chapter 163, and F.A.C <br />Rule 9J-11. <br /> <br />NOW, THEREFORE, BE IT ENACTED BY THE CITY COMMISSION OF THE CITY OF CASSELBERRY, <br />FLORIDA, AS FOLLOWS:- <br /> SECTION I. That Chapter 66, Section 66-29 of the City of Casselberry Code, as amended and <br />supplemented, said Chapter adopting the Comprehensive Plan of the City of Casselberry, Florida, <br />regulating and restricting the use of lands located within the City of Casselberry, Florida, be, and the same <br />is hereby amended to include properties as Medium Density Residential, for those parcels of land located <br />at 88 and 100 Plumosa Avenue, as requested by the owner of said land described as: <br /> <br />Ordinance 04-1123 <br />Page 1 <br /> <br /> <br />
