(,7) The possession of any open or unsealed container of alcoholic beverage by <br />any duly ordained or authorized minister, pastor, priest, rabbi, or any other similarly <br />designated person, or any religious monastery, chumh or religious body, but only for <br />purposes specifically related to the fulfillment of their religious duties. <br /> <br /> (8) The possession of any open or unsealed container of alcoholic beverage in a <br />motor vehicle, park, highway or parking lot, by any law enforcement officer and <br />employees of law enforcement agencies, but only while in the authorized performance <br />and scope of their lawful and official duties. <br /> <br /> (9) The possession of any open or unsealed container of alcoholic beverage by <br />any person at a "block party" or other activity of a similar nature permitted by the City. <br /> <br />The exceptions set forth in this Section shall apply only to the possession and <br />transportation of open or unsealed containers of alcoholic beverage and do not apply to the <br />drinking or consuming of any alcoholic beverage except for the authorized consumption by <br />passengers of certain vehicles as set forth in subsections (4) and (6) of this Section. <br /> <br /> D. ENFORCEMENT. Any officer duly authorized to enforce the laws of the <br />State of Florida or the ordinances of the City of Casselberry is duly authorized to enforce <br />this Ordinance. <br /> <br /> E. PENALTY. Any person convicted of a violation of any provision of this <br />ordinance where no specific penalty is provided by state law shall, upon conviction, be <br />punished as provided in Section 1-13(a) of the City of Casselberry Code of Ordinances. <br />Section 10-9(B)(1) shall be punishable as a civil infraction as provided in Fla. Stat. <br />s.316.1936. <br /> <br /> SECTION 2. SEVERABILITY. If any section or portion of a section of this <br />Ordinance proves to be invalid, unlawful or unconstitutional, it shall not be held to impair <br />the validity, force or effect of any other section or part of this Ordinance. <br /> <br /> SECTION 3. CODIFICATION. It is the intention of the City Commission of the City <br />of Casselberry, Florida, and it is hereby ordained that the provisions of this Ordinance shall <br />become and be made a part of the Code of Ordinance of the City of Casselberry, Florida; <br />that the Sections of this Ordinance may be renumbered or re-lettered to accomplish such <br />intention; that the word, "Ordinance" may be changed to "Section," "Article," or other <br />appropriate word. <br /> <br /> SECTION 4. CONFLICTS. All ordinances or parts of ordinances in conflict herewith <br />be and the same are hereby revoked. <br /> <br /> SECTION 5. EFFECTIVE DATE.
