Wells, AICP, Community Development Director 95 Triplet Lake Drive Casselberry, FL 32707 ORDINANCE # 04-1114 AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, TO AMEND THE CITY OF CASSELBERRY COMPREHENSIVE PLAN, BY AMENDING THE OFFICIAL FUTURE LAND USE MAP ESTABLISHING THE FUTURE LAND USE DESIGNATION OF MEDIUM DENSITY RESIDENTIAL (MDR) FOR THOSE PARCELS DESCRIBED IN SECTION I OF THIS ORDINANCE; PROVIDING FOR CONFLICTS, SEVERABILITY, AND AN EFFECTIVE DATE. Whereas, the property described in Section I was annexed into the City of Casselberry on November 10, 2003; and Whereas, a Public Hearing on the question of amending the Seminole County Medium Density Residential future land use designation of the property hereinafter described, has been duly held in the City of Casselberry, Florida and at such hearing, interested parties and citizens for and/or against the proposed establishment of the City of Cassetberry Medium Density Residential future land use designation were heard; and Whereas, the Casse~berry Planning and Zoning Commission/Land Planning Agency has he~d a public hearing with due public notice to consider the comprehensive plan amendment; and Whereas, after said Public Hearing, the City Commission of the City of Casselberry, Florida, has held a public hearing to consider the comprehensive plan amendment and has determined that the Future Land Use designation of said properties shall be established as Medium Density Residential as that designation is defined in Future Land Use Element Policies FLU 1.2, as amended and supplemented, of the Comprehensive Plan of the City of Casselberry, Florida; and Whereas, such amendments are permitted subject to the provisions of F.S. Chapter 163, and F.A.C Rule 9J-11. NOW, THEREFORE, BE IT ENACTED BY THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: SECTION I. That Chapter 66, Section 66-29 of the City of Casselberry Code, as amended and supplemented, said Chapter adopting the Comprehensive Plan of the City of Casselberry, Florida. regulating and restricting the use of lands located within the City of Casselberry, Florida, be, and the same is hereby amended to include properties as Medium Density Residential, for those parcels of land located on Marshall Road, as requested by the owner of said land described as: Ordinance 04-1114 Page 1
