Wells, AICP, Community Development Director 95 Triplet Lake Drive Casselberry, FL 32707 ORDINANCE # 04-1113 AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, TO AMEND THE CITY OF CASSELBERRY COMPREHENSIVE PLAN, BY AMENDING THE OFFICIAL FUTURE LAND USE MAP ESTABLISHING THE FUTURE LAND USE DESIGNATION OF LOW INTENSITY NON-RESIOENTIAUMEDIUM DENSITY RESIDENTIAUSEMINOLA BLVD OVERLAY DISTRICT, PHASE II (LINP./MOPJSBOD-II) FOR THOSE PARCELS DESCRIBED IN SECTION I OF THIS ORDINANCE; PROVIDING FOR CONFLICTS, SEVERABILITY, AND AN EFFECTIVE DATE. Whereas, the property described in Section I was annexed into the City of Casselberry on August 25, 2003; and Whereas, a Public Hearing on the question of amending the Seminole County Low Density Residential future land use designation of the property hereinafter described, has been duly held in the City of Casselberry, Florida and at such hearing, interested parties and citizens for and/or against the proposed establishment of the City of Casselberry LINR/MDR/SBOD-II future land use designation were heard; and Whereas, the Casselberry Planning and Zoning Commission/Land Planning Agency has held a public hearing with due public notice to consider the comprehensive plan amendment; and Whereas, after said Public Hearing, the City Commission of the City of Casselberry, Florida, has held a public hearing to consider the comprehensive plan amendment and has determined that the Future Land Use designation of said properties shall be established as LINR/MDR/SBOD-II as that designation is defined in Future Land Use Element Polities FLU 1,6 and FLU 1.16, as amended and supplemented, of the Comprehensive Plan of the City of Casselberry, Flodda; and Whereas, such amendments are permitted subject to the provisions of F.S. Chapter 163, and F.A.C Rule 9J-11. NOW, THEREFORE, BE IT ENACTED BY THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: SECTION I. That Chapter 66, Section 66-29 of the City of Casselberry Code, as amended and supplemented, said Chapter adopting the Comprehensive Plan of the City of Casselbemj, Florida, regulating and restricting the use of lands located within the City of Casselberry, Florida, be, and the same is hereby amended to include properties as LINR/MDR/SBOD-II, for those parcels of land located at the end of Jamie Lane, as requested by the owner of said land described as: Ord[nance(~,-lll3 Page 1
