Wells, AICP, Community Development Director 95 Triplet Lake Drive Casselberry, FL 32707 ORDINANCE # 04-1112 AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, TO AMEND THE CITY OF CASSELBERRY COMPREHENSIVE PLAN, BY AMENDING THE OFFICIAL FUTURE LAND USE MAP ESTABLISHING THE FUTURE LAND USE DESIGNATION OF INDUSTRIAL (I) FOR THOSE PARCELS DESCRIBED IN SECTION I OF THIS ORDINANCE; PROVIDING FOR CONFLICTS, SEVERABILITY, AND AN EFFECTIVE DATE. Whereas, the property described in Section I was annexed into the City of Casselberry on June 23, 2003; and Whereas, a Public Hearing on the question of amending the Seminole County Industrial future land use designation of the property hereinafter described, has been duly held in the City of Casselberry, Florida and at such hearing, interested parties and citizens for and/or against the proposed establishment of the City of Casselberry Industrial future land use designation were heard; and Whereas, the Casselberry Planning and Zoning Commission/Land Planning Agency has held a public hearing with due public notice to consider the comprehensive plan amendment; and Whereas, after said Public Hearing, the City Commission of the City of Casselberry, Florida, has held a public hearing to consider the comprehensive plan amendment and has determined that the Future Land Use designation of said properties shall be established as Industrial as that designation is defined in Future Land Use Element Policies FLU 1.9, as amended and supplemented, of the Comprehensive Plan of the City of Casselberry, Florida; and Whereas, such amendments are permitted subject to the provisions of F.S. Chapter 163, and F.A.C Rule 9J-11. NOW, THEREFORE, BE IT ENACTED BY TH~ CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: SECTION I. That Chapter 66, Section 66-29 of the City of Casselberry Code, as amended and supplemented, said Chapter adopting the Comprehensive Plan of the City of Casselberry, Florida, regulating and restricting the use of lands located within the City of Casselberry, Florida, be, and the same is hereby amended to include properties as Industrial, for those parcels of land located on Belle Avenue, as requested by the owner of said land described as: LOT 11: LEG LOT 11 (LESS N 300 FT OF E 291 FT & S 150 FF OF E 291 FT) BLK A JOHNSONS POULTRY FARMSPB 6 PG 8 LOT 11C: LEG S 150 17' OF E 291 FT OF LOT 11 BLK A JOHNSONS POULTRY FARMS PB 6 PG 8 Ordinance 04-1112 Page 1
