Wells, AICP, <br />Community Development Director <br />95 Triplet Lake Drive <br />Casselberry, FL 32707 <br /> <br /> ORDINANCE # 04-1112 <br /> <br /> AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, TO AMEND THE <br /> CITY OF CASSELBERRY COMPREHENSIVE PLAN, BY AMENDING THE <br /> OFFICIAL FUTURE LAND USE MAP ESTABLISHING THE FUTURE LAND USE <br /> DESIGNATION OF INDUSTRIAL (I) FOR THOSE PARCELS DESCRIBED IN <br /> SECTION I OF THIS ORDINANCE; PROVIDING FOR CONFLICTS, SEVERABILITY, <br /> AND AN EFFECTIVE DATE. <br /> <br />Whereas, the property described in Section I was annexed into the City of Casselberry on June 23, <br />2003; and <br /> Whereas, a Public Hearing on the question of amending the Seminole County Industrial future land <br />use designation of the property hereinafter described, has been duly held in the City of Casselberry, Florida <br />and at such hearing, interested parties and citizens for and/or against the proposed establishment of the <br />City of Casselberry Industrial future land use designation were heard; and <br /> <br /> Whereas, the Casselberry Planning and Zoning Commission/Land Planning Agency has held a public <br />hearing with due public notice to consider the comprehensive plan amendment; and <br /> <br /> Whereas, after said Public Hearing, the City Commission of the City of Casselberry, Florida, has held <br />a public hearing to consider the comprehensive plan amendment and has determined that the Future Land <br />Use designation of said properties shall be established as Industrial as that designation is defined in Future <br />Land Use Element Policies FLU 1.9, as amended and supplemented, of the Comprehensive Plan of the <br />City of Casselberry, Florida; and <br /> Whereas, such amendments are permitted subject to the provisions of F.S. Chapter 163, and F.A.C <br />Rule 9J-11. <br /> <br />NOW, THEREFORE, BE IT ENACTED BY TH~ CITY COMMISSION OF THE CITY OF CASSELBERRY, <br />FLORIDA, AS FOLLOWS: <br /> SECTION I. That Chapter 66, Section 66-29 of the City of Casselberry Code, as amended and <br />supplemented, said Chapter adopting the Comprehensive Plan of the City of Casselberry, Florida, <br />regulating and restricting the use of lands located within the City of Casselberry, Florida, be, and the same <br />is hereby amended to include properties as Industrial, for those parcels of land located on Belle Avenue, as <br />requested by the owner of said land described as: <br /> <br />LOT 11: LEG LOT 11 (LESS N 300 FT OF E 291 FT & S 150 FF OF E 291 FT) BLK A JOHNSONS <br /> POULTRY FARMSPB 6 PG 8 <br />LOT 11C: LEG S 150 17' OF E 291 FT OF LOT 11 BLK A JOHNSONS POULTRY FARMS PB 6 PG 8 <br /> <br /> Ordinance 04-1112 <br /> Page 1 <br /> <br /> <br />
