RESOLUTION 07-1772 "A RESOLUTION OF THE CITY OF CASSELBERRY, FLORIDA, AUTHORIZING THE APPROVAL OF A RATE ADJUSTMENT FOR RESIDENTIAL SOLID WASTE AND RECYCLING COLLECTION SERVICES PROVIDED BY REPUBLIC SERVICES, INC; PROVIDING FOR CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE." WHEREAS, the City of Casselberry is currently under contract with Republic Services, Inc. for residential solid waste and recyclable collection; and WHEREAS, Exhibit 2 of said contract allows for rate adjustments after the first 12 months of the contract based on the previous year's consumer price index; and WHEREAS, Republic Services, Inc. has provided the City with calculations of percent increases from December 2005 to December 2006 based on a report from the U.S. Department of Labor, Bureau of Labor and Statistics; and WHEREAS, the City needs to adjust the residential solid waste rate based on the increases from January 1, 2005 and January 1, 2007; and WHEREAS, these rate adjustments shall also include indirect costs such as administrative, billing, and associated roadway repair costs; and WHEREAS, to avoid billing the retroactive amount to each of the City's approximately 8,000 residential solid waste customers for this interim period, the City wishes to assume the costs associated with the rate adjustment from January 1 through May 1, 2007; and WHEREAS, City staff has reviewed the proposed residential solid waste rate adjustment and recommends its approval. NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: SECTION I. The City Commission of the City of Casselberry hereby approves the residential solid waste rate adjustment, from $12.80 per month to $14.94, which includes the Consumer Price Index and indirect cost adjustments. SECTION II. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the provisions of this Resolution are hereby repealed. SECTION III. Severabilitv. If any Section or portion of a Section of this Resolution proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, or effect of any other Section or part of this Resolution. SECTION IV. Effective Date. This Resolution shall become effective immediately upon its passage and adoption.
