Smith, AICP, Acting Community Development Director City of Casselberry 95 Triplet Lake Dr, Casselberry, FL 32707 ORDINANCE 06-1204 AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, AMENDING PART III, CHAPTER II, DISTRICT AND GENERAL REGULATIONS, ARTICLE VII, SECTION 2-7.26(D)(1)(j)(2) OF THE CASSELBERRY CODE OF ORDINANCES ENTITLED "POOL ENCLOSURES" WITHIN THE SEMINOLA BOULEVARD OVERLAY DISTRICT (SBOD); AMENDING THE SETBACK REQUIREMENT; PROVIDING FOR CODIFICATION, CONFLICTS, SEVERABILITY AND AN EFFECTIVE DATE. WHEREAS, Part III, Chapter II, of the Unified Land Development Regulations establishes zoning districts and general regulations for the development of land within the corporate limits of the City of Casselberry, Florida; and WHEREAS, special design criteria were established for the Seminola Boulevard Overlay District (SBOD) to ensure cohesive and appropriate siting of structures; and WHEREAS, the current pool enclosure requirement was developed to allow placement of the exterior mechanical equipment at the rear of the structure; and WHEREAS, the adopted design criteria significantly impacts the living area at the rear of the structure due to conflicts between the roofline, the screen enclosure and the enclosure offset; and WHEREAS, words with double underlined type shall constitute additions to the original text and ctrike tl1rsllilt:1 shall constitute deletions to the original text. NOW THEREFORE, BE IT ENACTED BY THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: SECTION I.
