Florida 32707 <br /> <br />ORDINANCE # 03-1097 <br /> <br />AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA TO AMEND <br />THE CITY OF CASSELBERRY COMPREHENSIVE PLAN, BY AMENDING <br />THE OFFICIAL FUTURE LAND USE MAP ESTABLISHING THE FUTURE <br />LAND USE DESIGNATION OF MEDIUM DENSITY RESIDENTIAL (MDR) FOR <br />THOSE PARCELS DESCRIBED IN SECTION ONE OF THIS ORDINANCE; <br />PROVIDING FOR CONFLICTS, SEVERABILITY, AND AN EFFECTIVE DATE. <br /> <br />WHEREAS, a Public Hearing on the question of amending the City of Casselberry Low <br />Density Residential Future Land Use designation of the properties hereinafter described, has <br />been duly held in the City of Casselberry, Florida, and at such hearing, interested parties and <br />citizens for and/or against the proposed establishment of the City of Casselberry Low Density <br />Residential Future Land Use designation were heard; and <br /> <br />WHEREAS, the Casselberry Planning and Zoning Commission/Land Planning Agency <br />has held a public hearing with due public notice to consider the Comprehensive Plan <br />Amendment; and <br /> <br />WHEREAS, after said Public Hearing, the City Commission of the City of Casselberry, <br />Florida, has held a public hearing to consider the Comprehensive Plan Amendment and has <br />determined that the Future Land Use designation of said properties shall be established as <br />Medium Density Residential as that designation is defined in Future Land Use Element Policies <br />FLU 1.8, as amended and supplemented, of the Comprehensive Plan of the City of Casselberry, <br />Florida; and <br /> <br />WHEREAS, such amendments are permitted subject to the provisions of Chapter 163 of <br />the Florida Statutes and Rule 9J-11 of the Florida-Administrative Code. <br /> <br />NOW, THEREFORE, BE IT ENACTED BY THE CITY COMMISSION OF THE CITY OF <br />CASSELBERRY, FLORIDA, AS FOLLOWS: <br /> <br />SECTION ONE. That Chapter 66, Section 66-29 of the City of Casselberry's Code of <br />Ordinances, as amended and supplemented, said Chapter adopting the City of Casselberry's <br />Comorehensive Plan, regulating and restricting the use of lands within the City of Casselberry, <br />Florida, be, and the same is hereby amended to include property as Medium Density <br />Residential, for those parcels of land located on the northern side of Seminola Blvd between <br />Wyndham Way and NE Triplet Drive, as requested by the owners of said parcels totaling 1.8 <br />acres in size and described as: <br /> <br />Ordinance No. 03-1097 <br />Page 1 of 2 <br />
